DES:cb DES:dft O/18/9l (031/30) ,'18/91R 0 RIG I N A L 9/23/91 RES 0 L UTI 0 N N O. ---------- 11611 RESOLUTION SUSPENDING OPERATION OF SECTION 7.02 (b) OF SETTLEMENT AGREEMENT AND MASTER WATER SALES CONTRACT WITH THE CITY AND COUNTY OF SAN FRANCISCO FOR FISCAL YEAR 1991-1992 WHEREAS, pursuant to water supply contract dated August 8, 1984, by and between the City and County of San Francisco ("San Francisco" ) and the City of Redwood City, which contract incorporates by reference the terms and conditions of that certain "Settlement Agreement and Master Water Supply Contract" (the "Master Agreement" ) between San Francisco and certain suburban purchasers (the "Suburban purchasers") , this City obtains its potable water supply from the Hetch Hetchy water system; and WHEREAS, Section 7.01 of the Master Agreement provides that San Francisco shall supply to the Suburban Purchasers pursuant thereto a maximum annual average metered supply of water defined as the "Supply Assurance"; and WHEREAS, Section 7.02(b) of the Master Agreement provides a methodology for the allocation of the Supply Assurance among the Suburban Purchasers and, further, provides for allocation of a portion thereof designated as the "Suburban Allocable Water"; and WHEREAS, subject to agreement between said Suburban Purchasers to the contrary, the allocation of the Supply Assurance is based upon prior water usage by individual purchasers; and WHEREAS, pursuant to Ordinance No. 1968, adopted May 23, 1988, this Council determined and declared a water shortage "-'-~'--r-'---'"
