<br />DES:cb <br />DES:dft <br /> <br />O/18/9l (031/30) <br />,'18/91R <br /> <br />0 RIG I N A L <br /> <br />9/23/91 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />---------- <br /> <br />11611 <br /> <br />RESOLUTION SUSPENDING OPERATION OF SECTION 7.02 (b) OF <br />SETTLEMENT AGREEMENT AND MASTER WATER SALES CONTRACT <br />WITH THE CITY AND COUNTY OF SAN FRANCISCO FOR FISCAL <br />YEAR 1991-1992 <br /> <br />WHEREAS, pursuant to water supply contract dated August 8, <br /> <br />1984, by and between the City and County of San Francisco ("San <br /> <br />Francisco" ) <br /> <br />and <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />Redwood <br /> <br />City, <br /> <br />which <br /> <br />contract <br /> <br />incorporates <br /> <br />by <br /> <br />reference <br /> <br />the <br /> <br />terms <br /> <br />and <br /> <br />conditions <br /> <br />of <br /> <br />that <br /> <br />certain "Settlement Agreement and Master Water Supply Contract" <br /> <br />(the <br /> <br />"Master <br /> <br />Agreement" ) <br /> <br />between <br /> <br />San <br /> <br />Francisco <br /> <br />and <br /> <br />certain <br /> <br />suburban <br /> <br />purchasers <br /> <br />(the <br /> <br />"Suburban <br /> <br />purchasers") , <br /> <br />this <br /> <br />City <br /> <br />obtains <br /> <br />its <br /> <br />potable water <br /> <br />supply <br /> <br />from the <br /> <br />Hetch Hetchy water <br /> <br />system; and <br /> <br />WHEREAS, Section 7.01 of the Master Agreement provides that <br /> <br />San Francisco shall supply to the Suburban Purchasers pursuant <br /> <br />thereto a maximum annual average metered supply of water defined <br /> <br />as the "Supply Assurance"; and <br /> <br />WHEREAS, Section 7.02(b) of the Master Agreement provides a <br /> <br />methodology for the allocation of the Supply Assurance among the <br /> <br />Suburban Purchasers and, <br /> <br />further, <br /> <br />provides for allocation of a <br /> <br />portion thereof designated as the "Suburban Allocable Water"; and <br /> <br />WHEREAS, <br /> <br />subject <br /> <br />to <br /> <br />agreement <br /> <br />between <br /> <br />said <br /> <br />Suburban <br /> <br />Purchasers <br /> <br />to <br /> <br />the <br /> <br />contrary, <br /> <br />the <br /> <br />allocation <br /> <br />of <br /> <br />the <br /> <br />Supply <br /> <br />Assurance <br /> <br />is <br /> <br />based <br /> <br />upon <br /> <br />prior <br /> <br />water <br /> <br />usage <br /> <br />by <br /> <br />individual <br /> <br />purchasers; and <br /> <br />WHEREAS, <br /> <br />pursuant to Ordinance No. <br /> <br />1968, <br /> <br />adopted May <br /> <br />23, <br /> <br />1988, <br /> <br />this <br /> <br />Council <br /> <br />determined <br /> <br />and <br /> <br />declared <br /> <br />a <br /> <br />water <br /> <br />shortage <br /> <br />"-'-~'--r-'---'" <br />
