<br />DES:cb <br />DES:dft <br /> <br />q/18/91 (031/30) <br />'18/91R <br /> <br />emergency <br /> <br />within <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />Redwood <br /> <br />City, <br /> <br />and <br /> <br />established <br /> <br />regulations and restrictions on the delivery and consumption of <br /> <br />water, and established penalties for violations thereof; and <br /> <br />WHEREAS, <br /> <br />in consideration of the water shortage emergency <br /> <br />and similar action to be taken by all other Surburban Purchasers, <br /> <br />on September 19, 1988, this Council adopted Resolution No. 10909 <br /> <br />suspending the operation of the <br /> <br />aforesaid Section 7.02 (b) <br /> <br />for <br /> <br />fiscal years 1987-1988 and 1988-l989; and <br /> <br />WHEREAS, <br /> <br />similarly, <br /> <br />on <br /> <br />December 10, <br /> <br />1990, <br /> <br />this <br /> <br />Council <br /> <br />adopted <br /> <br />Resolution No. <br /> <br />ll452 <br /> <br />suspending <br /> <br />the <br /> <br />operation <br /> <br />of <br /> <br />the <br /> <br />aforesaid <br /> <br />Section <br /> <br />7.02(b) <br /> <br />for <br /> <br />fiscal <br /> <br />years <br /> <br />1989-1990 <br /> <br />and <br /> <br />1990-1991; and <br /> <br />WHEREAS, on February 26, <br /> <br />1991 and April 23, <br /> <br />1991, <br /> <br />the San <br /> <br />Francisco <br /> <br />Public <br /> <br />Utilities <br /> <br />Commission <br /> <br />continued <br /> <br />in effect <br /> <br />the <br /> <br />water <br /> <br />shortage <br /> <br />emergency <br /> <br />and <br /> <br />the mandatory water <br /> <br />conservation <br /> <br />program theretofore declared <br /> <br />and <br /> <br />established by <br /> <br />it, <br /> <br />including <br /> <br />water rationing and excess use charges for fiscal year 1991-1992; <br /> <br />and <br /> <br />WHEREAS, <br /> <br />the <br /> <br />provisions <br /> <br />of <br /> <br />the <br /> <br />Master <br /> <br />Contract <br /> <br />which <br /> <br />determine <br /> <br />permanent <br /> <br />entitlements <br /> <br />to <br /> <br />a <br /> <br />portion <br /> <br />of <br /> <br />the <br /> <br />Supply <br /> <br />Assurance based on water usage are not compatible with measures <br /> <br />taken <br /> <br />by <br /> <br />all <br /> <br />signatories <br /> <br />to <br /> <br />the <br /> <br />Master <br /> <br />Agreement <br /> <br />to <br /> <br />reduce <br /> <br />consumption <br /> <br />of <br /> <br />water <br /> <br />under <br /> <br />their <br /> <br />respective <br /> <br />water <br /> <br />supply <br /> <br />contracts; and <br /> <br />WHEREAS, <br /> <br />it <br /> <br />is <br /> <br />appropriate <br /> <br />to <br /> <br />continue <br /> <br />to <br /> <br />suspend <br /> <br />the <br /> <br />provisions <br /> <br />of <br /> <br />the <br /> <br />Master <br /> <br />Agreement <br /> <br />during <br /> <br />the <br /> <br />period <br /> <br />of <br /> <br />the <br /> <br />2 <br /> <br />---r---- <br />
