/. 5e-1

REPORT

July 11, 2005

Subject
Resolution of Intention to Vacate a Portion of St. Francis Street

Recommendation
Adopt a Resolution of Intention to vacate a portion of St. Francis Street, south of
Redwood Avenue, setting a public hearing for September 12, 2005, and ordering a
posting of a Notice of Intent to Vacate.

Background
The property owner at 1535 Redwood Avenue has requested the vacation of the dead-
end portion of St. Francis Street fronting his property on the north side of St. Francis
Street. Attachment "A" depicts the area to be vacated.

The property owner at 1605 Redwood Avenue (on the opposite side of the street) has
expressed his consent for said vacation fronting his property on the south side of St.
Francis Street. Per the Streets & Highways Code, a public hearing needs to be
conducted to take jnput from any person who may have interest in this vacation.

The portion of St. Francis Street adjacent to this property dead ends at Redwood
Creek. Therefore, there is no pedestrian or vehicular access to the remainder of St.
Francis Street further to the southeast. (The attached vicinity map shows the circulation
pattern of the streets in that vicinity.) Thus, there is no practical use for this street due
to the creek crossing. Also, it should be noted that this site cannot be reserved as a
park because it was originally dedicated for public use as a street. In that event, the
law requires that, if that parcel is no longer used for public street purposes, the
ownership reverts back to the adjoining properties.

Pacific Gas and Electric, RCN, Comcast, and SBC have consented to the vacation with
the condition that the vacated area be retained as a public service easement. The City
also needs the easement for future watermain extension across the vacated area, and
for maintenance of the Redwood Creek lined drainage channel.

Staff has reviewed the vacation and recommends approvals subject to the Conditions
listed on Attachment "B". The City does not need this portion of St. Francis Street for
traffic circulation. The Planning Commission acted on this matter, and found the
vacation to be in conformance with the General Plan.

Next Steps
Following adoption of this resolution, the City Council will take public testimony on
September 12, 2005, and either vote to adopt a resolution to vacate or not approve the
vacation at all. In the former case, the ownership of the actual street would be
determined by a records search of the chain of title. The Title Company would then
issue the appropriate title guarantee to the future owners.
