<br />DES:djg-c <br />'JES:djg-c <br />DES:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />02/15/83R <br />07/29/83R <br />ll/20/83R <br />12/08/83R <br /> <br />Premises. <br /> <br />Any additional pipelines shall be located under any <br /> <br />railroad tracks, spur tracks, roads or access roads or any other <br /> <br />improvements of Lessor in a safe and conventional manner and as <br /> <br />Lessor may reasonably designate. <br /> <br />Except as hereinabove provided, <br /> <br />such pipelines may be installed above ground, provided such <br />installation complies with all applicable laws and regulations. <br /> <br />6. <br /> <br />WHARF FACILITIES. <br /> <br />(a) Non-exclusive Use. <br /> <br />Lessee is <br /> <br />hereby granted a non-exclusive permission and privilege to use and <br /> <br />conduct operations on those certain wharf facilities of Lessor <br /> <br />designated on Exhibit "B" attached hereto and by this reference <br /> <br />incorporated herein, commonly known as Wharf No.5 (hereinafter, <br /> <br />the "Wharf Facilities") located adjacent to the Leased Premises and <br /> <br />to which the pipelines constructed and installed within the ease- <br /> <br />ment area described in Exhibit "A" hereof are connected. <br /> <br />Said <br /> <br />non-exclusive use shall be subject to all terms and conditions of <br /> <br />Lessor's tariff regulations pertaining to the use and operation of <br /> <br />Lessor's wharf and terminal facilities. <br /> <br />Lessor shall use its best <br /> <br />efforts to accommodate all of Lessee's vessels when they arrive at <br /> <br />the Wharf Facilities, provided Lessee, the vessels, or the agents <br /> <br />of either, comply with applicable nomination and other operational <br /> <br />regulations of Lessor. <br /> <br />(b) <br /> <br />Maintenance. <br /> <br />During the term of this lease Lessor shall, <br /> <br />at Lessor's expense, maintain the Wharf Facilities and ancillary <br /> <br />facilities adjacent to the Leased Premises and/or the Wharf <br /> <br />10 <br /> <br />.........--""-",,-"""" <br />
