Lessor shall maintain the Wharf Facilities and ancillary facilities in accordance with good industry standards, ordinary wear and tear excepted, and in accordance with all applicable statutes, ordinances, rules and regulations of all federal, state and local governmental bodies having jurisdiction. Lessor shall maintain a minimum depth at the Wharf Facilities of approximately 35 feet. The conditions aforesaid shall be maintained continuously, except for reasonable interruptions in order to effect maintenance and repairs to the Wharf Facilities and ancillary facilities. 7. IMPROVEMENTS. The parties acknowledge that upon the commencement of the term hereof certain improvements, constructed and installed by or for Lessee or Lessee's predecessors in interest under the Prior Lease (described and defined in Paragraph 38), are existing and located in and upon the Leased Premises and are owned by Lessee. Said existing improvements include, but are not necessarily limited to, an administration building and warehouse facility, petroleum storage tanks, pumps, pipelines, protective bunkers, and appurtenances thereto. Lessee accepts the Leased Premises and said improvements in their present condition and hereby agrees that said improvements shall be operated, maintained, repaired or replaced solely at Lessee's expense.
