<br />D¡:;S:djg-c <br />r ~:djg-c= <br />D~S:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />02/15/'83R <br />07/29/83R <br />11/20/83R <br />12/08/83R <br /> <br />Facilities in a condition adequate to receive and load or unload <br /> <br />barges and vessels delivering or receiving bulk liquid petroleum <br /> <br />products to or from Lessee's terminal. <br /> <br />Lessor shall maintain the <br /> <br />Wharf Facilities and ancillary facilities in accordance with good <br /> <br />industry standards, ordinary wear and tear excepted, and in <br /> <br />accordance with all applicable statutes, ordinances, rules and <br /> <br />regulations of all federal, state and local governmental bodies <br /> <br />having jurisdiction. <br /> <br />Lessor shall maintain a minimum depth at the <br /> <br />Wharf Facilities of approximately 35 feet. <br /> <br />The conditions <br /> <br />aforesaid shall be maintained continuously, except for reasonable <br /> <br />interruptions in order to effect maintenance and repairs to the <br /> <br />Wharf Facilities and ancillary facilities. <br /> <br />7. <br /> <br />IMPROVEMENTS. <br /> <br />The parties acknowledge that upon the <br /> <br />commencement of the term hereof certain improvements, constructed <br /> <br />and installed by or for Lessee or Lessee's predecessors in interest <br /> <br />under the Prior Lease (described and defined in Paragraph 38), are <br /> <br />existing and located in and upon the Leased Premises and are owned <br /> <br />by Lessee. <br /> <br />Said existing improvements include, but are not <br /> <br />necessarily limited to, an administration building and warehouse <br /> <br />facility, petroleum storage tanks, pumps, pipelines, protective <br /> <br />bunkers, and appurtenances thereto. <br /> <br />Lessee accepts the Leased <br /> <br />Premises and said improvements in their present condition and <br /> <br />hereby agrees that said improvements shall be operated, maintained, <br /> <br />repaired or replaced <br /> <br />solely at Lessee's expense. <br /> <br />Any additional <br /> <br />11 <br /> <br />....,......--..... . <br />
