<br />DES:djg-c <br />~S : dj g-c <br />ußS:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />02/15/83R <br />07/29/83R <br />11/20/83R <br />12/08/83R <br /> <br />19. <br /> <br />INSURANCE. <br /> <br />(a) Coverage. <br /> <br />As a condition precedent to the <br /> <br />effectiveness of this lease agreement, and in partial performance <br /> <br />of Lessee's obligations of indemnity as set forth hereinbelow, <br />Lessee shall procure and maintain in full force and effect while <br /> <br />this lease agreement shall remain in effect, a policy or policies <br /> <br />of public liability and property damage insurance from a company <br /> <br />or companies authorized to do business in the State of Calif- <br /> <br />ornia, or otherwise reasonably acceptable to Lessor's Port <br /> <br />Manager, with minimum coverages for Lessee's operations and <br /> <br />occupancy hereunder (whether conducted in, upon, on or over the <br /> <br />Leased Premises, the Wharf Facilities, or at or about any other <br /> <br />place at Lessor's Port terminal facilities pursuant to this lease <br /> <br />agreement) for the first Rental Period established pursuant to <br /> <br />paragraph 3(a) in the following amounts: <br /> <br />A single combined liability limit of Five Million <br />Dollars ($5,000,000.00) or One Million Dollars <br />($I,OOO,OOO.OO) for injury or death to anyone <br />person or third party property damage, and Five <br />Million Dollars ($5,000,000.00) for anyone <br />occurrence; <br /> <br />(b) <br /> <br />Review. <br /> <br />Lessor and Lessee may review the amounts of <br /> <br />minimum coverage set forth above for each successive Rental <br /> <br />Period and Lessee shall increase the insurance coverage to such <br /> <br />amount or amounts as the parties may agree; provided, however, that <br /> <br />if the parties are unable to so agree, the determination of the <br /> <br />reasonable amount of insurance coverage shall be submitted to <br /> <br />arbitration as provided in paragraph 32; provided, further, that <br /> <br />23 <br />
