<br />DES:djg-c <br />-O;S:djg-c <br />uES:djg-c <br />DES:djg-c <br />DES:djg-c <br /> <br />11/23/82 <br />02/15/83R <br />07/29/83R <br />11/20/83R <br />12/08/83R <br /> <br />required by the California Environmental Quality Act or other <br /> <br />enactment in pursuance thereof, recordation and transcription of <br /> <br />public hearings (if such services are required by Lessor) held in <br /> <br />connection with the award of this lease agreement, and such other <br /> <br />incidental costs pertaining thereto. <br /> <br />32. <br /> <br />ARBITRATION. <br /> <br />Any dispute which this lease provides <br /> <br />shall be submitted to arbitration shall be finally settled by <br /> <br />arbitration in San Francisco, California in accordance with the <br /> <br />Commercial Arbitration Rules of the American Arbitration <br /> <br />Association by three (3) arbitrators, who shall be appointed <br /> <br />as follows: <br /> <br />Lessor and Lessee each shall appoint one (1) <br /> <br />arbitrator, and the third arbitrator shall be appointed by <br /> <br />the two arbitrators appointed by the parties. <br /> <br />If the said <br /> <br />two arbitrators fail for any reason to appoint a third <br /> <br />arbitrator within sixty (60) days following their appointment, <br /> <br />the third arbitrator shall be appointed in accordance with the <br /> <br />said Rules. <br /> <br />33. <br /> <br />LITIGATION COSTS. <br /> <br />In the event either party hereto <br /> <br />commences an action against the other party arising out of or in <br /> <br />connection with this lease agreement, the prevailing party shall <br /> <br />be entitled to have and recover from the losing party reasonable <br /> <br />expenses incurred in litigation, including attorneys fees and court <br /> <br />costs. <br /> <br />34. <br /> <br />NOTICES. <br /> <br />Any notice required or permitted to be given <br /> <br />40 <br /> <br />-¡--'-'."~'-Y-"'.""'-'---' <br />
