<br />legal descriptions (including metes and bounds descriptions when <br /> <br />necessary) required to conveyor reconvey any real property or <br /> <br />interest therein, including without limit all easements and <br /> <br />utility licenses needed in connection with the Structure. <br /> <br />3. <br /> <br />Utility Relocations. <br /> <br />The City shall be solely <br /> <br />responsible at its own cost and expense for identifying the <br /> <br />location of all pipelines (including, without limit, high <br /> <br />pressure petrol pipelines, gas and water pipelines), fiber optic <br /> <br />lines and all other utilities of whatever nature, both overhead <br /> <br />and underground on or over Railroad's right-of-way in the <br /> <br />vicinity of the Structure (collectively, <br /> <br />"Facilities"), and for <br /> <br />relocating or arranging for the relocation of all said Facilities <br /> <br />which would interfere with City's construction of the Structure. <br /> <br />City shall be responsible for contacting and shall work with the <br /> <br />owners of these Facilities to identify their exact location and <br /> <br />arrange for relocation as needed. <br /> <br />All such relocations shall be <br /> <br />effected in compliance with Railroad's Right of Way Standards for <br /> <br />Longitudinal and Transverse Utility Encroachments Manual. <br /> <br />City <br /> <br />hereby specifically acknowledges that Railroad has made no <br /> <br />representations or warranties as to the number, type or location <br /> <br />of such Facilities in the vicinity of the proposed Structure. <br /> <br />4. <br /> <br />Railroad Construction. <br /> <br />City shall design, engineer <br /> <br />and effect at its sole cost and expense all new construction, <br /> <br />relocation and reconstruction of the "shoofly" track and the main <br /> <br />track needed to complete the Structure. <br /> <br />All plans and designs <br /> <br />related to track rearrangement shall be subject to the prior <br /> <br />217831.2 <br /> <br />-3- <br /> <br />.
