<br />sanctions, costs or expenses for injuries to or death of any <br /> <br />person (including, but not limited to, passengers, employees and <br /> <br />contractors of City and Railroad) and damage to or loss of <br /> <br />property arising out of or resulting from any negligent act or <br /> <br />omission by the JPB, its agents, employees, contractors or <br /> <br />subcontractors in performance of its obligations under this <br /> <br />Agreement. <br /> <br />JPB's obligation to defend shall include the payment <br /> <br />of all reasonable attorneys' fees and all other costs and <br /> <br />expenses of suit, and if any judgment is rendered against City, <br /> <br />City's indemnitee's or anyone of them, JPB shall, at its <br /> <br />expense, satisfy and discharge the same. <br /> <br />10. <br /> <br />Insurance and Bondinq. <br /> <br />City shall assure that <br /> <br />City's construction contractor(s) shall maintain in full force <br /> <br />and effect, until completion and acceptance of the work specified <br /> <br />in their contract, the following policies of insurance: <br /> <br />( a) <br /> <br />Workers' Compensation and Employers' <br /> <br />Liability Insurance. <br /> <br />Contractor shall secure the payment of Workers' <br /> <br />Compensation and/or Federal Employers' Liability Act Coverage <br /> <br />( FELA) <br /> <br />(whichever is applicable) to its employees, as required by <br /> <br />the Federal Employers' Liability Act of 1908 applying to instate <br /> <br />railroad employees or as required by Section 1860 of the <br /> <br />California Labor Code (Chapter 1000, Statutes of 1965), or any <br /> <br />subsequent amendments or successor acts thereto governing the <br /> <br />liability of employers to their employees. <br /> <br />217831.2 <br /> <br />-9- <br /> <br />.
