<br />DAL:mgl02/18/91 <br /> <br />lOO4/4~) <br /> <br />low income persons and small families as defined in health and <br /> <br />Safety Code Sections 50079.5 and/or 50105. <br /> <br />The persons selected <br /> <br />to reside in said home shall have been residents of San Mateo <br /> <br />County immediately prior to living in said home. <br /> <br />Lessee shall be <br /> <br />a non-profit organization, and shall not make a profit from the <br /> <br />use of the Leased Premises hereunder. <br /> <br />Lessee represents that it <br /> <br />has prior experience in the operation of similar homes. <br /> <br />Should Lessee assign its rights under this Lease pursuant to <br /> <br />Paragraph 19, or should the use of the Leased Premises otherwise <br /> <br />change <br /> <br />from <br /> <br />the <br /> <br />purpose <br /> <br />herein <br /> <br />set <br /> <br />forth, <br /> <br />the <br /> <br />rental <br /> <br />amount <br /> <br />described in Paragraph 3 shall be adjusted in accordance with the <br /> <br />provisions of Paragraph 20. <br /> <br />5. <br /> <br />RECORDS; AUDIT. <br /> <br />Lessee shall at all times during the <br /> <br />term of this agreement keep or cause to be kept true and complete <br /> <br />books, <br /> <br />records and accounts of all financial transactions <br /> <br />(and <br /> <br />date used in determining <br /> <br />selection of residents), <br /> <br />relating <br /> <br />to <br /> <br />Lessee's use of the Leased Premises, during such time as such use <br /> <br />is consistent with the purpose set forth in Paragraph 4, or is <br /> <br />otherwise determined by Lessor to be a "Public purpose" within <br /> <br />the <br /> <br />meaning <br /> <br />of <br /> <br />Article <br /> <br />16, <br /> <br />Section <br /> <br />6 <br /> <br />of <br /> <br />the <br /> <br />California <br /> <br />Constitution. <br /> <br />All books, records, and accounts required to be kept under <br /> <br />this lease by Lessee or its agents shall, at all reasonable times <br /> <br />be open and made available for inspection or audit by Lessor, its <br /> <br />agents or employees. <br /> <br />6. <br /> <br />LESSEE'S <br /> <br />IMPROVEMENTS. <br /> <br />Lessee <br /> <br />shall, <br /> <br />at <br /> <br />its <br /> <br />own <br /> <br />expense, <br /> <br />construct, or cause to be constructed wi thin and upon <br /> <br />3 <br /> <br />TT" <br />
