<br />DAL:r-g: 02/18/91 <br /> <br />(004/45) <br /> <br />extended coverage insurance on the improvements constructed and <br /> <br />maintained by Lessee on the Leased Premises, <br /> <br />and appurtenances <br /> <br />thereto. <br /> <br />Said insurance shall be in an amount of at least ninety <br /> <br />percent (90%) of the full replacement value of the aforementioned <br /> <br />improvements. <br /> <br />Said policy or policies <br /> <br />shall be <br /> <br />issued in the <br /> <br />name of Lessee, Lessee's lender <br /> <br />(if applicable) <br /> <br />and Lessor, as <br /> <br />their interests appear. <br /> <br />In the event the improvements above described are destroyed <br /> <br />from a <br /> <br />risk <br /> <br />covered by the <br /> <br />aforesaid <br /> <br />insurance, <br /> <br />Lessee <br /> <br />shall <br /> <br />advise Lessor of any and all insurance proceeds paid or to be <br /> <br />made available to Lessee by reason thereof, and shall commit said <br /> <br />monies to repair or reconstruct the improvements so destroyed. <br /> <br />9. <br /> <br />INDEMNIFICATION. <br /> <br />Lessee <br /> <br />shall <br /> <br />and <br /> <br />will <br /> <br />defend <br /> <br />indemnify <br /> <br />and <br /> <br />save <br /> <br />harmless <br /> <br />Lessor, <br /> <br />its <br /> <br />officers, <br /> <br />agents <br /> <br />and <br /> <br />employees, <br /> <br />from and against any and all claims, <br /> <br />demands, <br /> <br />loss, <br /> <br />judgements, <br /> <br />or liabilities of any kind or nature which Lessor, <br /> <br />its officers, agents and employees may sustain or incur or which <br /> <br />may be imposed upon them or any of them for injury to or death of <br /> <br />persons, or damage to property, as a result of, or arising out of <br /> <br />this lease or occupancy and use of the Leased Premises by Lessee, <br /> <br />its officers, agents, employees, licensees, invitees or visitors. <br /> <br />10. <br /> <br />MAINTENANCE. Lessee shall at its own cost and expense <br /> <br />keep <br /> <br />and <br /> <br />maintain <br /> <br />the Leased Premises, <br /> <br />and <br /> <br />all <br /> <br />facilities <br /> <br />or <br /> <br />improvements thereon or which may be placed or constructed upon <br /> <br />the Leased Premises in reasonable order and repair and shall keep <br /> <br />all portions of said premises clean, <br /> <br />neat, <br /> <br />orderly and as <br /> <br />fee <br /> <br />from weeds, <br /> <br />papers or debris or other articles or things which <br /> <br />6 <br /> <br /> <br />T lr. <br />
