<br />DAL:mgl02/18/91 <br /> <br />(UU4/4~) <br /> <br />prompt <br /> <br />performance <br /> <br />thereof <br /> <br />by <br /> <br />Lessee. <br /> <br />No <br /> <br />delay, <br /> <br />failure <br /> <br />or <br /> <br />omission of Lessor to re-enter the Leased Premises or to exercise <br /> <br />any right, power, privilege or option arising from any default, <br /> <br />nor subsequent acceptance of rent then due or thereafter accrued <br /> <br />shall impair any such right, power, privilege or option, <br /> <br />or be <br /> <br />construed to be a waiver of any such default or relinquishment <br /> <br />thereof, or acquiescence therein, and no notice by Lessor shall <br /> <br />be required to restore or revive time as <br /> <br />the essence thereof <br /> <br />after waiver by Lessor of default in one of more instances. <br /> <br />It <br /> <br />is agreed that each and all of the rights, powers, options, or <br /> <br />remedies provided by law, and that exercise of one right, power, <br /> <br />option or remedy by lessor shall not impair its rights or any <br /> <br />other right, power, option or remedy. <br /> <br />24. <br /> <br />HOLDING <br /> <br />OVER. <br /> <br />Should <br /> <br />Lessee <br /> <br />hold <br /> <br />over <br /> <br />the <br /> <br />Leased <br /> <br />Premises after expiration of the term, or after this agreement <br /> <br />has terminated in any manner such holding over shall be deemed <br /> <br />merely a tenancy from month to month and at the rentals herein <br /> <br />provided, payable proportionately monthly in advance as to basic <br /> <br />rental, but otherwise on the same terms and conditions as herein <br /> <br />provided. <br /> <br />25. <br /> <br />ATTORNEYS' <br /> <br />FEES, <br /> <br />COSTS. <br /> <br />In <br /> <br />the <br /> <br />event <br /> <br />either <br /> <br />party <br /> <br />hereto commences any legal action against the other party arising <br /> <br />ou t of or in connection with this <br /> <br />lease, <br /> <br />the prevailing party <br /> <br />shall <br /> <br />be <br /> <br />entitled <br /> <br />to <br /> <br />have <br /> <br />and <br /> <br />recover <br /> <br />from the <br /> <br />losing party <br /> <br />reasonable attorneys' fees and costs of suit. <br /> <br />26. <br /> <br />NOTICES. <br /> <br />All <br /> <br />notices <br /> <br />to be <br /> <br />given <br /> <br />to <br /> <br />Les see may be <br /> <br />given in writing, <br /> <br />personally or by depositing the same in the <br /> <br />18 <br /> <br />.TT. <br />
