<br />DAL:mglJ2/18/9l <br /> <br />lUU4/Q::>J <br /> <br />the unpaid rent for the balance of the term exceeds the amount of <br /> <br />such rental loss which Lessee proves could be reasonably avoided. <br /> <br />Lessee shall not be considered in default as to any provision of <br /> <br />this lease, where such default is the result of, or pursuant to, <br /> <br />any process order or decree of any court, governmental, judicial <br /> <br />or regulatory body. <br /> <br />If Lessee abandons or vacates the property, while in default <br /> <br />of payment of rent, Lessor may consider any property left on the <br /> <br />premises to be abandoned and may dispose of same in any manner <br /> <br />allowed by <br /> <br />la',,;. <br /> <br />In th~ ~v~nt Lessor reasonably believes that <br /> <br />such abandoned property has no value, it may de discarded. <br /> <br />22. <br /> <br />CONTINUANCE UPON DEFAULT. <br /> <br />In the event Lessee <br /> <br />shall <br /> <br />fail to pay the rents provided for herein as they become due, or <br /> <br />otherwise fails to fulfill the conditions and covenants contained <br /> <br />in this lease, or any or either of them, and Lessee has abandoned <br /> <br />the Leased premi ses , <br /> <br />Lessor in addition to any other rights or <br /> <br />remedies it may have at law or in equity, shall have the option <br /> <br />of continuing this lease. <br /> <br />In such event, Lessor may enforce all <br /> <br />its rights and remedies under the lease, including the right to <br /> <br />recover the rent as it becomes due, and may in accordance with <br /> <br />Section 1954 of the Civil Code, re-enter said premises in order <br /> <br />to maintain, preserve, or relet the premises. <br /> <br />23. <br /> <br />NON-WAIVER. <br /> <br />No waiver by Lessor at any time of any of <br /> <br />the terms, conditions, covenants or agreements of this lease or <br /> <br />of any forfeiture shall be deemed or taken as a waiver at any <br /> <br />time <br /> <br />thereafter <br /> <br />of <br /> <br />the <br /> <br />same <br /> <br />or <br /> <br />any <br /> <br />other <br /> <br />term, <br /> <br />condition, <br /> <br />covenant or agreement herein contained, <br /> <br />nor of the strict and <br /> <br />17 <br /> <br />TI <br />
