<br />DAL:mgl02/18/91 <br /> <br />(004/4:J) <br /> <br />Lessor <br /> <br />and <br /> <br />lessee <br /> <br />or his <br /> <br />proposed assignees <br /> <br />respectively <br /> <br />shall each pay all cost and expenses of the appriser appointed by <br /> <br />them, and shall share equally the costs and fees of the appraiser <br /> <br />appointed by the appraisers designated by Lessor and Lessee or <br /> <br />Lessee's proposed assignee. <br /> <br />The <br /> <br />fair <br /> <br />market <br /> <br />rental <br /> <br />of <br /> <br />the <br /> <br />Leased <br /> <br />Premises <br /> <br />shall be <br /> <br />binding <br /> <br />for <br /> <br />any <br /> <br />period(s) <br /> <br />of <br /> <br />time <br /> <br />which <br /> <br />the <br /> <br />parties <br /> <br />thereto <br /> <br />agree. <br /> <br />If the parties thereto cannot agree upon the amount of <br /> <br />future rental adjustments, such future adjustments shall also be <br /> <br />determined by appraisal as hereinabove set forth. <br /> <br />21. <br /> <br />TERMINATION UPON DEFAULT. <br /> <br />In the event Lessee shall <br /> <br />fail to pay the rents provided for herein as they become due, or <br /> <br />otherwise fails to fulfill the conditions and covenants contained <br /> <br />in this lease, or any or either of them, Lessor in addition to <br /> <br />any other rights or remedies it may have at law or in equity, <br /> <br />shall have the option after giving of not less than thirty (30) <br /> <br />days <br /> <br />written <br /> <br />notice <br /> <br />of <br /> <br />such <br /> <br />default <br /> <br />to <br /> <br />Lessee <br /> <br />and <br /> <br />to <br /> <br />each <br /> <br />sublessee, <br /> <br />pursuant <br /> <br />to <br /> <br />Section <br /> <br />1611 <br /> <br />of <br /> <br />the <br /> <br />Code <br /> <br />of <br /> <br />Civil <br /> <br />Procedure, <br /> <br />of terminating this <br /> <br />lease <br /> <br />and declaring said <br /> <br />lease <br /> <br />forfei ted and the <br /> <br />term hereof ended, <br /> <br />unless, within said time <br /> <br />lessee <br /> <br />shall <br /> <br />cure <br /> <br />said <br /> <br />default. <br /> <br />In <br /> <br />such <br /> <br />event, <br /> <br />Lessor <br /> <br />may <br /> <br />commence <br /> <br />legal proceedings to remove all persons <br /> <br />and property <br /> <br />from the Leased Premises, and may recover from Lessee all damages <br /> <br />it may incur by reason of the breach of the lease, including the <br /> <br />cost of recovering the Leased Premises, and including the worth <br /> <br />at the time of such termination, or at the time of award if suit <br /> <br />be instituted to enforce this provision, of the amount by which <br /> <br />16 <br /> <br />Tr <br />
