Authorize staff to allow all Downtown retail, restaurant, and entertainment <br />businesses who purchase validation equipment to issue validations to their <br />customers, in compliance with the Parking Facilities Agreement, without the <br />payment of a per-validation fee to the City. The motion passed by a <br />unanimous roll call vote. MINUTE ORDER 05-154 <br /> <br />Recess: 9:05-9:20 p.m. <br /> <br />7. PUBLIC HEARINGS <br /> <br />A. Appeal Hearing in the denial of a Massage Establishment Permit, under <br />18A.23 RCC (Continued from July 11,2005) <br /> <br />Police Sergeant Harper gave the background on the topic. <br /> <br />Mayor Ira opened the public hearing. <br /> <br />Public Comment: <br />Jason Dai, representing Tiffany Xu, spoke regarding the three reasons for denial <br />stated in Sergeant Harper's letter. Mr. Oai stated that his identification shows that <br />the City issued permits to three graduates of the same school that Ms. Xu had <br />graduated from. He stated that Jason Dai cannot be considered financially <br />involved with the business because the business license stage has not been <br />reached as yet. Regarding the businesses located in Fremont and Walnut Creek, <br />he stated that the Fremont business has been in good standing for 5 years <br />without any problems. The Walnut Creek business has been in place for one <br />year. He stated that upon filing for the use permit, he and Ms. Xu followed all the <br />rules, did not misrepresent any information, provided identification and <br />necessary paperwork. He referred to a July 11, 2005 Palo Alto Daily News article <br />indicating that documents had been falsified in order to obtain a massage permit. <br />He stated that all paperwork has been filed and there is nothing illegal, offering <br />investigation of the Fremont and Walnut Creek businesses. He stated that while <br />there may have been omission or lack of completeness of documents, there was <br />no falsification. He expressed satisfaction with the Planning Division on the <br />subject but that he was unable to discuss with Sergeant Harper. He stated that <br />he was open to any questions. <br /> <br />MIS Hartnett/Howard to close the public hearing.
