<br />Pump Repair Service Company’s bid did contain one minor irregularity. The Notice <br />Inviting Bids required corporate bidders to identify the name of the state where they are <br />chartered on the Bid Pricing Form. Pump Repair Service Company did not include the <br />name the state where it is chartered on the Bid Pricing Form. Staff recommends that the <br />City Council waive this minor irregularity and accept Pump Repair Service Company’s <br />bid as the irregularity was not the result of fraudulent intent on the part of the bidder and <br />the best interests of the public would be served by such waiver. This decision is <br />authorized by the Notice Inviting Bids and Section 2.68(C) of the Purchasing Ordinance. <br />The Notice Inviting Bids states: <br /> <br />The City reserves the right to: . . . Waive informalities and irregularities in <br />the bids. <br /> <br />Section 2.68(C) of the Purchasing Ordinance states: <br /> <br />The Council may waive any irregularities in bids received or permit the <br />correction of erroneous bids when the Council finds that the irregularity or <br />error was not the result of fraudulent intent on the part of the bidder and <br />that the best interests of the public would be served thereby. <br /> <br />Staff anticipate a project timeline of six weeks for installation of the repaired pumps. In <br />the meantime, the impacted pump stations remain operational and are expected to <br />adequately handle storm water loads. The three pumps under repair are secondary <br />pumps that provide an additional layer of reliability to each pump station, but will not <br />hinder the regular performance of the station. <br /> <br />ALTERNATIVES <br />Council may choose not to approve this request. However, staff strongly recommends <br />making repairs at this time in order to ensure all storm water facilities are well equipped <br />for the upcoming winter season. <br /> <br />FISCAL IMPACT <br />Funds in the amount of $111,719.00 are available in the FY 2017-18 storm water <br />account for this purchase. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under CEQA as defined in CEQA Guidelines, section <br />15378, because it has no potential for resulting in either a direct or foreseeable physical <br />change in the environment. <br /> <br />6.1.B. - Page 2
