7. On June 12, 2017, the San Mateo County Superior Court appointed <br />CONSERVATOR as temporary conservator of the person and estate of OWNER, <br />who could not manage his health or finances. Following his appointment, <br />CONSERVATOR began working with CITY to develop a plan to abate the public <br />nuisance conditions at the PROPERTY and to cancel the VOID DEED to clear title <br />to the PROPERTY. <br />8. On July 12, 2017, CONSERVATOR obtained a court order cancelling the VOID <br />DEED which CONSERVATOR recorded in the Official Records of San Mateo <br />County on July 13, 2017. The recordation of the VOID DEED quieted title to the <br />PROPERTY in OWNER'S name. <br />9. On July 18, 2017 the San Mateo County Superior Court appointed <br />CONSERVATOR as conservator of the person and estate of OWNER finding that <br />OWNER was unable to provide for his personal needs for physical health, food, <br />clothing, or shelter, and was substantially unable to manage his financial resources <br />or to resist fraud or undue influence. CONSERVATOR Letters of Conservatorship <br />were recorded in the Official Records of San Mateo County thereafter. Since his <br />appointment, CONSERVATOR has been working with CITY to implement a plan <br />to abate the nuisance conditions at the PROPERTY. <br />10. Based on the adoption of Resolution 15574, the CITY is authorized to demolish all <br />of the buildings on the PROPERTY at any time in order to abate the public <br />nuisance. CONSERVATOR wishes to defer the CITY's demolition of the buildings <br />on the PROPERTY to provide him an opportunity to abate the public nuisance <br />voluntarily. Specifically, CONSERVATOR wishes the opportunity to properly <br />reconstruct or repair the buildings on the PROPERTY as outlined in the <br />recommended remedies noted in Exhibit D to the Resolution rather than demolish <br />the buildings on the PROPERTY. The CITY requires abatement of the public <br />nuisance to take place in a timely manner. <br />11. On August 16, 2017, the San Mateo County Superior Court entered its order <br />authorizing CONSERVATOR to implement his plan to reconstruct or repair the <br />buildings on the PROPERTY to abate the public nuisance. <br />12. Because CITY requires the public nuisance be abated in a timely manner, and <br />because CONSERVATOR wishes to have an opportunity to abate the public <br />nuisance voluntarily by properly reconstructing or repairing the buildings on the <br />PROPERTY, the PARTIES wish to provide a reasonable, but limited, timeline for <br />CONSERVATOR to abate the nuisance. <br />AGREEMENT <br />Now, therefore, in consideration of the recitals and mutual promises contained <br />herein, PARTIES mutually agree as follows: <br />ATTY/AGR/2017.233/COMPLIANCE AGREEMENT —112-120 VERA AVENUE <br />REV: 10-12-17 RL <br />Page 2 of 7 <br />
