TERM OF AGREEMENT. This Agreement shall commence upon approval of <br />this Agreement by the San Mateo County Superior Court in Case No. 17PR000595 <br />("EFFECTIVE DATE') and shall be effective until such time the public nuisance <br />has been abated to the satisfaction of CITY's Building Official and Fire Marshal, <br />and all relevant fees and CITY costs associated with the abatement of the nuisance <br />have been paid in full. CONSERVATOR will seek ex parte approval of this <br />Agreement within 5 days of signature by both parties. <br />2. AUTHORITY TO ACT. CONSERVATOR expressly warrants and guarantees <br />that he is authorized to act on behalf of OWNER, the property owner of 112-120 <br />Vera Avenue, Redwood City, by virtue of his appointment as Conservator and as <br />authorized in the August 16, 2017 court order referenced in paragraph 10 above. <br />3. ABATEMENT OF IMMEDIATE FIRE HAZARD. CITY confirms that <br />CONSERVATOR has removed all outdoor combustible weeds, vegetation, trash, <br />and debris from the PROPERTY to the satisfaction of the CITY's Building Official <br />and Fire Marshal. <br />4. COMPLIANCE REQUIREMENTS FOR ABATEMENT. As an alternative to <br />demolition by the CITY, CONSERVATOR must comply with the following <br />deadlines and requirements for proper reconstruction and repair of the buildings on <br />the PROPERTY: <br />a. Within fifteen (15) days of the EFFECTIVE DATE of this Agreement, <br />CONSERVATOR shall obtain the services of a licensed architect to create <br />formal architectural plans for the proper reconstruction and repair of the <br />buildings on the PROPERTY. CONSERVATOR will not demolish the <br />buildings on the PROPERTY without Court approval. <br />b. Within ninety (90) days of the EFFECTIVE DATE of this Agreement, <br />CONSERVATOR shall submit an application for a building permit to the <br />CITY, shall pay to the CITY all required plan check and permit fees, and <br />shall submit to the CITY acceptable formal architectural plans for the proper <br />reconstruction and repair of the buildings on the PROPERTY based on all <br />applicable building and technical codes, including the installation of fire <br />sprinklers if required by the Redwood City Code. <br />C. Within fifteen (15) days of the issuance of any plan check comments from <br />the CITY to CONSERVATOR, CONSERVATOR shall submit revised <br />plans to the CITY responding to the plan check comments. <br />d. CONSERVATOR shall obtain a building permit within 48 hours of <br />notification by the CITY of the approval of the plans. <br />e. At the time of the issuance of the building permit, CONSERVATOR shall <br />have obtained all necessary financing for the proper reconstruction and <br />repair of the buildings on the PROPERTY and shall have contracted with a <br />licensed contractor to perform the proper reconstruction and repair. <br />f. Within one hundred twenty (120) days of the issuance of the building permit <br />by the CITY, CONSERVATOR shall initiate, complete, and obtain final <br />AT TY/AGR/2017.233/COMPLIANCE AGREEMENT -112-120 VERA AVENUE. <br />REV: 10-12-17 RL <br />Page 3 of 7 <br />
