8.C. - Page 16 <br />five -sevenths (5/7ths) vote of the whole eCouncil, ordinances ordering or otherwise relating to <br />elections, and ordinances relating to public improvements, the cost of which is to be borne wholly <br />or in part by special assessments, may go into effect at the will of the eCouncil. <br />Section 17. PLANNING COMMISSION: <br />There shall be a eCity pPlanning eCommission, which shall consist of seven members, who shall <br />be appointed by the Council, to serve for four (4) years each, and thereafter until their respective <br />successors are appointed and qualified, none of whom shall hold any other public office or <br />position in the City. No Derson shall be aDDointed to the Planning Commission for more than <br />four full consecutive terms. A Dartial term to which a Derson is aDDointed to fill a vacancv on the <br />Planning Commission shall not be included in comDutina consecutive terms. The full term <br />during which a member may resign shall be included in the same manner as if no resignation <br />had taken Dlace. If a member is not reaDDointed after serving one or more terms, such member <br />may be aDDointed in a later aDDointment cvcle and shall be eligible to serve four consecutive <br />terms from the date of the later aDDointment. Full terms or _Dartial terms served urior to January <br />1, 201A shall be included in commuting consecutive terms. When a member comDletes a term <br />without being reaDDointed to the succeeding term, including instances in which a member is not <br />reaDDointed because of the term limits set forth herein, such member shall continue to serve <br />until their successor is aDDointed and aualified. <br />All members of the eCommission shall, at the time of their appointments and continuously <br />during their incumbencies, be residents and electors of the City. The eCommission shall elect its <br />eChairperson from among its members. Neither the City Attorney, the Planning Director nor any <br />deputy or assistant of either of them, shall have the right to vote or enter into deliberations but <br />shall be present in an advisory capacity only. (As amended November 6, 2007, filed by Secretary <br />of State March 12, 2008). <br />The pPlanning eCommission shall exercise all powers and duties granted it by ordinance or <br />resolution of the Council now or hereafter in effect and shall exercise such additional powers and <br />duties as may now or hereafter be provided for by such general laws of the State as are not in <br />conflict with this Charter, or any ordinance or resolution of the Council. <br />The members of the present eCity pPlanning eCommission in office at the time of this Charter <br />taking effect shall continue in office until the end of the terms for which they have been <br />respectively appointed.
