the approval of this segment of the construction of the Improvements and the <br />dedication of easements to City, the parties hereto agree as follows: <br />1. Improvements. Owner shall, at Owner's own cost and expense, <br />construct all of the improvements ("Improvements"), furnish all the materials, and <br />do all the work hereinafter described in accordance with, and as provided for in, <br />the plans prepared for Owner by Bohley/Maley Associates, Civil Engineers, <br />entitled, "Westport Office Park Phase I Construction of Water Main <br />Improvements from the end of Existing Bridge Parkway to Station 25+00±", as <br />well as City's specifications entitled, "Engineering Standards — City of Redwood <br />City, Volumes I, II, and III," which plans and specifications are on file in the <br />office of the City Engineer. Said Improvements shall also be constructed in strict <br />compliance with the provisions of Article VII, Chapter 29 of the Code of the City <br />of Redwood City. To the extent that if a conflict exists between the plans and <br />specifications and said Chapter 29 in regard to the standard for a particular <br />improvement, the stricter standard shall govern. In view of the requirement of <br />completion of the Improvements by the date set forth below (the "Completion <br />Date"), City agrees that the provisions of Chapter 29 shall be as said provisions <br />exist as of the date of approval of this Agreement. In the event that the <br />Improvements are not completed by the Completion Date, the Improvements <br />which have not been completed may, at City's sole discretion, be subject to the <br />then applicable provisions of Chapter 29.
