<br />Permittee shall further release and hold City harmless from any destruction to or <br /> <br />alteration of Permittee's improvements by City, or its employees, agents or contractors, <br /> <br />(except as such destruction or alteration is caused by willful act or gross negligence) in <br /> <br />the exercise of City's ownership rights to the real property adjacent to and abutting the <br /> <br />Subject Premises. <br /> <br />9. INSURANCE. Permittee shall secure, carry and maintain at all times during <br /> <br />the period covered by this revocable permit, at Permittee's sole cost and expense, <br /> <br />commercial general liability and property damage insurance, which insurance shall be <br /> <br />in the following minimum amounts: <br /> <br />(a) <br /> <br />$1,000,000 for injury or death of anyone person and $1,000,000 for anyone <br />occurrence; <br /> <br />(b) <br /> <br />Property damage insurance in the amount of $1 ,000,000. <br /> <br />A certificate or certificates evidencing the maintenance of the required <br /> <br />insurance shall be deposited with the City Clerk prior to any use of the Subject <br /> <br />Premises by Permittee. In addition to the aforesaid certificates, the Permittee shall file <br /> <br />with the City Clerk the following endorsements: <br /> <br />(c) <br />(d) <br /> <br />Agmt-312 <br />F/sh/sh/RC/Counci1 <br />11/15/99 <br />FXS:fs <br /> <br />(a) <br /> <br />Endorsement precluding cancellation or reduction in coverage before <br />the expiration of 30 days after City shall have received any notification <br />thereof from the insurance carrier; <br /> <br />(b) <br /> <br />Endorsement naming the City of Redwood City, its Council, officers, <br />boards, commissions, agents and employees as additional insureds; <br /> <br />Standard cross liability endorsement; <br /> <br />An endorsement stating that the insurance afforded thereby to City, its <br />Council, officers, boards, commissions, agents, and employees shall be <br />primary insurance to the full limits of the liability of the policy, and that if <br />City, its, Council, officers, boards, commissions, agents, and employees <br />have other insurance against a loss covered by such a policy, such <br />other insurance shall be excess insurance only. <br /> <br />4 <br />
