<br />SCOPE OF WORK <br />FOR <br />W ASHBUR~, BRISCOE & McCARTHY <br /> <br />Key Elements <br /> <br />. <br /> <br />Provide legal advice, specifically on the Clean Water Act (Section 404(b)( I), Endangered <br />Species Act(Section 7), and land use issues. <br /> <br />Facilitate the Corps of Engineers (CaE) permit processing through contacts with the <br />District Engineer and his legal consultant. <br /> <br />Review all our correspondence with the CaE to ensure cohesive and aggressive responses <br />to the many conflicting demanås from the agencies. <br /> <br />Provide clarification to the COE's District Engineers and his legal staff, if and when <br />appropriate, on the legal theories in which the City is operating under, in eliminating <br />different project alternatives which the CaE and the agencies are advocating. <br /> <br />Provide the CaE with the possible legal ramifications which they may be facing if they <br />were to condition the permit with events that will most likely lead the City into a legal <br />battles with property owners. <br /> <br />Retain R. T. Huffman and Associates, an expert in the field, to render a second <br />professional opinion as to our pian of approach, namely the mitigation effectiveness and <br />the effect of our project on the endangered species. <br /> <br />Coordinate and consolidate contacts with our State anå Federal political representatives to <br />keep them informed of roadblocks that the CaE has set up for us. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />" <br /> <br />Page. 3 <br />
