<br />Agreement No. FT A04A36 <br />Sheet 2 of 2 <br />(CTC Resolution dated December 10, 1992 and as amended by CTC Resolution <br />G-93-08 dated May 5, 1993) which are made an express part of this Agreement as <br />Attachment IV, if applicable [X ], together with and any other terms and <br />conditions that are contained within the CTC's approving Resolution, <br />Attachment II. <br /> <br />3. [ <br /> <br />] Project Approval <br /> <br />A. AGENCY has received approval through California Transportation <br />Commission (CTC) Resolution #XXXX (Attachment V, if applicable [ ]) for <br />Project Approval of STATE funds for a public passenger railroad project <br />("PROJECT") as described in the attached Resolution. The effective date for the <br />Project Approval is the date of the CTC approving resolution. Agency desires <br />approval of PROJECT and commitment of STATE to its share of the funds <br />available for PROJECT, should future unbudgeted and unallocated funds <br />become available. <br /> <br />B. Terms and conditions required of AGENCY to enable STATE to reimburse <br />AGENCY are set forth in the CTC Commission Allocation of Bond Funds to <br />Projects (CTC Resolution #G-91-9 dated April 25, 1991) which are made an <br />express part of this Agreement as Attachment VI, if applicable [ ], together <br />with and any other terms and conditions that are contained within the CTC's <br />approving Resolution, Attachment V. <br /> <br />4. AGENCY shall not begin any work on the above named PROJECT, until a <br />completed Scope of Work has been approved by STATE. AGENCY must, at the <br />time of each quarterly review, provide details of all right-of-way, construction, <br />rolling stock, and other related expenditures to STATE. <br /> <br />5. Upon the allocation of STATE funds to the above named PROJECT and the <br />execution of a Fund Transfer Agreement with STATE, this agreement will be <br />terminated and the applicable provisions of this Agreement shall be <br />incorporated into and made a part of that Fund Transfer Agreement to ensure <br />continued eligibility of these approved advance expenditure of local funds or <br />local match credits.
