10.A-IZ <br /> Development Regulation is in conflict with this Agreement if it alters eny Exaction <br /> except as expressly permilted under this Agreement, or if it alters any of the Existing <br /> Approvals, including without limitation, any of the following: <br /> <br /> (i) Land uses; <br /> (ii) Density or intensity of land uses[ <br /> (iii) GBFA[ <br /> (iv) The height, size or location of buildings; <br /> (v) Parking; <br /> (vi) Project documents, including site plans, elevations, off-site improvements and <br /> <br /> landscaping plans as set forth in Exhibit C. <br /> <br /> (f) Exactions not in conflict with this Agreement are exactions that are mandated or <br /> assessed by any governmental agency other than City and imposed or collected <br /> through City for that governmental agency and exactions that City is required to impose <br /> by another governmental agency and/or by law and Exactions imposed by City after the <br /> Effective Date, which are applicable to all properties, to all commercial properties, or to <br /> all office buildings within City's boundaries if those Exactions are not imposed: <br /> <br /> (i) In lieu of or for the purpose of financing the construction of, or for providing, any <br /> of the Facilities; or <br /> <br /> (ii) For any other purpose for which Exactions exist on or prior to the Effective Date <br /> under the Existing Development Regulations. <br /> <br /> (g) Where the Exactions listed in Exhibit D are calculated based on the cost of <br /> construction, City shall calculate those fees based on the probable actual cost of <br /> construction. <br /> <br /> -6- <br /> Agml-45011300 ! <br /> FXS:dr <br /> 02/04/02R, 02/12/O2R <br /> <br /> <br />
