February 25, 2002 <br /> <br />Subject <br />Approval of legal services agreement with McDonough, Holland and Allen, for <br />representation related to redevelopment and City real property/land use services. <br /> <br />Recommendation <br />1. That both the Agency and the City approve a legal services agreement with <br /> McDonough, Holland and Allen and authorize the City Attomey/General Counsel to <br /> execute same. <br />2. That the Agency approves the use of funds already budgeted in the Agency general <br /> fund (807) for attomey services for costs associated with this agreement. . <br />3. That the City approves the use of funds already budgeted in the City general fund for <br /> paralegal services for costs associated with this agreement. <br /> <br /> Background <br /> <br /> In March of 2001, the Redevelopment Agency authorized execution of a Disposition and <br /> Development Agreement (the "DDA") with Western Innisfree Ventures, LLC and Blake <br /> Hunt Ventures I, LLC for the development of a two level retail-cinema project, parking <br /> garage and office structure. Staff anticipates that the developer will request that the DDA <br /> be amended to reflect this past year's economic downturn. <br /> <br /> In light of the above project, in the fall of last year, staff issued a request for proposals for <br /> legal services. After reviewing and evaluating the proposals received, staff is <br /> recommending the retention of the law firm of McDonough, Holland and Allen to serve as <br /> special legal counsel for redevelopment and real property/land use issues. <br /> <br /> With regard to the downtown retail-cinema DDA, McDonough, Holland and Allen has <br /> particular knowledge on the legal aspects of downtown redevelopment projects and will be <br /> able to share this knowledge with staff as the DDA and accompanying documents are <br /> amended and reviewed. <br /> <br /> In addition to the downtown retail-cinema project, the City has received a proposal for a <br /> large development along Bair Island Road consisting of residential and commercial units as <br /> well as several marinas. The Glenborough-Pauls, LLC/Marina Shores project is <br /> anticipated to require specialized knowledge of land use and real property law that can also <br /> <br /> <br />
