be provided by the law firm of McDonough, Holland and Allen. Ms Iris. Yang would ~erve as <br />the primary attorney for the firm. Hourly rates for the firms principal attorneys are $200- <br />$260 per hour;, for associate attomeys the houdy rate is $100-$180 per hour and; $80-$125 <br />for legal assistants. Ma. Yang's current hourly rate is $205. A copy of the legal services <br />agreement with McDonough, Holland and Allen is attached. <br /> <br />Staff recommends that the Agency Board authorize the retention of the law firm of <br />McDonough, Holland and Allen to serve as special counsel for redevelopment issues. We <br />are also recommending that the City Council authorize this agreement so that the firm can <br />work on City-related projects. Currently any services provided under this contract for City <br />projects would come from the City Attorney's budget. <br /> <br />Alternative <br />The Agency Board/City Council could determine to seek other special legal counsel to <br />represent Its Interests In redevelopment and real property/land use Issues. <br /> <br />Fiscal Impact <br />Redevelopment Aeencv <br />Funds are included In the 2001-02 Redevelopment Agency budget for costs associated <br />with. the former contract City Attomey/Agency General Counsel's work related to <br />redevelopment projects. The account balance is approximately $45,000 which staff <br />believes to be sufficient to complete this fiscal year. <br /> <br />City Council <br />Funds are Included In the 2001-02 City Attomey's Budget for a vacant paralegal position <br />sufficient to complete the services contemplated under the agreement for the current fiscal <br />year. Staff is recommending that $40,000 of this amount be used for these special legal <br />services. Assuming the Board and Council approve this agreement, the 2002-03 budget <br />will need to include funds to continue the legal services through the next fiscal year. At this <br />time, staff is examining the possibility of recovering certain legal services costs from <br />developers.
