1 Contractor will Collect these fees from service recipients on the regular Billings and 2 remit collected amounts to Agency and/ or SBWMA on a quarterly basis, as provided 3 below. This fee shall be a Pass-Through Cost. Contractor may be required to separately 4 identify the AB939 Fee and other specific costs on bills as determined and directed by 5 Agency. 6 7 3.02.2 Time and Method of Payment. Except as expressly provided 8 below, during the Term of this Agreement and any extension of it, Contractor shall 9 remit one-fourth (1/4th) of the total annual amount identified as the AB939 fee in the 10 rate structure quarterly to either Agency or SBWMA in the same fashion and subject to 11 the same terms and conditions as the Franchise Fee described in 3.01 above. Contractor 12 shall continue to pay the same amount of money to Agency each quarter until the 13 AB939 fee has been changed. The City Council approved on April 9, 2001, by Resolution 14 No. 14194, the current monthly AB 939 fee of 0.4% of monthly billings effective March 1, 15 2001. 16 17 3.03 Other Fees. The Agency andlor SBWMA shall reserve the right to set 18 "other" fees, as it deems necessary. These fees will be treated as a Pass-Through Cost. 19 The amount, time and method of payment and adjustment process will be set similar to 20 Section 3.01 above. 21 22 23 ARTICLE 4 24 DIRECT SERVICES 25 26 4.01 General. The work to be done by Contractor pursuant to this Agreement 27 shall include, but not be limited to, the furnishing of all labor, supervision, equipment, 28 materials, supplies, and all other items necessary to perform the services required. The 29 enumeration of, and specification of requirements for, particular items of labor or 30 equipment shall not relieve Contractor of the duty to furnish all others, as may be 31 required, whether enumerated elsewhere in the Agreement or not. 32 33 The work to be done by Contractor pursuant to this Agreement shall be 34 accomplished in a thorough and professional manner so that the residents and 35 businesses within the Agency are provided reliable, courteous and high-quality service 36 at all times. The enumeration of, and specification of requirements for, particular 37 aspects of service quality shall not relieve Contractor of the duty of accomplishing all 38 other aspects in the manner provided in this Article, whether such other aspects are 39 enumerated elsewhere in the Agreement or not. 40 41 4.02 Solid Waste Collection. 42 43 4.02.1 Single Family Dwellings Collection.
