<br />1 calculations used to calculate Contractor's diversion tonnage. Should Contractor <br />2 exceed these diversion requirements, it shall be eligible for the financial benefits of the <br />3 performance incentives described in Section 6.07 of this Agreement. Should Contractor <br />4 fail to meet these diversion requirements, Contractor will be subject to the liquidated <br />5 damage provisions described in Section 11.03 in addition to compensation for any and <br />6 all other damages to the Agency resulting from the Contractor's failure. Parties shall <br />7 meet by June 2000 to develop revised goals for years beyond 2002. These goals assume <br />8 that contractor retains the right to utilize the Facilities, acknowledging that the <br />9 programs designed to achieve the commercial Recycling diversion goals are not <br />10 duplicative to those offered at the Facilities. <br />11 <br />12 4.05.2 Residential Program Guarantees. Additionally, Contractor is <br />13 operating diversion programs targeted at the residential Waste Generators. <br />14 Contractor shall at no time during this Agreement Recycle less than the 1999 tonnage <br />15 level and shall make best efforts to increase that amount annually. Contractor's <br />16 failure to maintain current residential Recycling levels will subject it to the provisions <br />17 of Section 11.01E. <br />18 <br />19 4.06 Collection Locations. It is understood that all Recyclable Materials, and <br />20 Plant Materials Collection services will be provided at Curbside, with the following <br />21 exceptions: <br />22 <br />23 A. Porch or backyard pick-up of residential Plant Materials will be <br />24 provided by Contractor to residential Customers who are frail, or are medically <br />25 disabled and as a result are unable to bring their Recyclable Materials and Plant <br />26 Materials Containers to the curb. Contractor's Collection crew will pick up and return <br />27 Containers to the alternate Collection location for these service recipients. <br />28 <br />29 B. Residents of Multi-Family Dwelling Units of two (2) to four (4) <br />30 units will use the same Collection Containers as residents of Single Family Dwellings. <br />31 Contractor will Collect these Containers at Curbside. Residents of Multi-Family <br />32 Dwelling Units of five (5) or more units will use larger Containers, such as wheeled <br />33 carts or bins, which will be Collected in a central location reasonably accessible by <br />34 Collection Vehicles. <br />35 <br />36 4.07 Special Material Collection Programs. <br />37 <br />38 4.07.1 Christmas Trees. Contractor shall operate an annual Christmas <br />39 Tree Collection program for all of Agency's service recipients. Contractor shall offer to <br />40 each service recipient, as part of this program, the Curbside Collection of Christmas trees <br />41 that are not flocked and do not contain tinsel or other decorations, on at least two (2) <br />42 days within the first two weeks of January following Christmas. Contractor shall make <br />43 best efforts to incorporate this program into the Plant Materials Collection service <br />44 described in Section 4.04.
