<br />1 <br />2 Contractor shall train its employees in courtesy, shall prohibit the use of loud or <br />3 profane language, and shall instruct Collection crews to perform the work quietly. <br />4 Contractor shall use its best efforts to assure that all employees present a neat <br />5 appearance and conduct themselves in a courteous manner. If any employee is found <br />6 to be discourteous or not to be performing services in the manner required by this <br />7 Agreement, Contractor shall take all necessary corrective measures including, but not <br />8 limited to, transfer, discipline or termination. If Agency has notified Contractor of a <br />9 Complaint related to discourteous or improper behavior, Contractor will consider <br />10 reassigning the employee to duties not entailing contact with the public while <br />11 Contractor is pursuing its investigation and corrective action process. Contractor shall <br />12 provide suitable operations, health and safety training for all of its employees who use <br />13 or operate equipment or who are otherwise directly involved in Collection or other <br />14 related operations. <br />15 <br />16 4.14 Identification Required. Contractor shall provide its employees and <br />17 subcontractors with identification for all individuals who may make personal contact <br />18 with residents or businesses in the Agency. Agency may require Contractor to notify <br />19 service recipients yearly of the form of said identification. Contractor shall provide a <br />20 list of current employees, and subcontractors to Agency upon request. <br />21 <br />22 4.15 Fees and Gratuities. Contractor shall not, nor shall it permit any agent, <br />23 employee, or subcontractors employed by it, to request, solicit, demand, or accept, <br />24 either directly or indirectly, any compensation or gratuity for services or the Collection, <br />25 transportation, Recycling, processing, and Disposal of Solid Waste, Recyclable <br />26 Materials, Commercial ()rganic Materials and Plant Material, otherwise required under <br />27 this Agreement. <br />28 <br />29 4.16 Non-Discrimination. Contractor shall not discriminate in the provision of <br />30 service or the employment of Persons engaged in performance of this Agreement on <br />31 account of race, color, religion, sex, age, sexual orientation, physical handicap or <br />32 medical condition in violation of any applicable federal or state law. <br />33 <br />34 4.17 Change in Collection Schedule. Contractor shall notify Agency thirty <br />35 (30) days prior to, and residential service recipients not later than fourteen (14) days <br />36 prior to, any change in residential Collection operations which results in a change in the <br />37 day on which Solid Waste, Recyclable Materials, and Plant Materials Collection occurs. <br />38 Contractor will not permit any service recipient to go more than seven (7) days without <br />39 service in connection with a Collection schedule change. <br />40 <br />41 4.18 Report of Accumulation of Solid Waste; Unauthorized Dumping. <br />42 Contractor shall direct its drivers to note (1) the addresses of any service recipients at <br />43 which they observe that Solid Waste is accumulating and is not being delivered for <br />44 Collection; and (2) the address, or other location description, at which Solid Waste has <br /> Atty j Agrj2005.022 <br /> 060205 -25- <br />
