1 per twelve (12) month period, the Contractor shall make Containers available for 2 purchase at a price not to exceed the cost to Contractor of purchasing the Containers. 3 4 4.12 Litter Abatement. 5 6 4.12.1. Minimization of Spills. Contractor shall use due care to prevent 7 Solid Waste, Recyclable Materials and/ or Plant Materials or fluids from leaking being 8 spilled and/or scattered during the Collection or transportation process. If any material 9 or fluids leak or are spilled during Collection, Contractor shall promptly clean up all 10 such materials. Each Collection vehicle shall carry a broom and shovel at all times for 11 this purpose. 12 13 Contractor shall not transfer loads from one vehicle to another on any 14 public street, unless it is necessary to do so because of mechanical failure, accidental 15 damage to a vehicle, or a pre-approved method of Solid Waste transfer between 16 vehicles, without prior written approval by Agency. 17 18 4.12.2 Clean Up. During the Collection or transportation process, 19 Contractor shall clean up litter in the immediate vicinity of any storage area (including 20 the areas where Collection bins and debris boxes are delivered for Collection) whether 21 or not Contractor has caused the litter. Contractor shall discuss instances of repeated 22 spillage not caused by it directly with the Waste Generator responsible and will report 23 such instances to Agency. Agency will attempt to rectify such situations with the Waste 24 Generator if Contractor has already attempted to do so without success. 25 26 4.12.3 Covering of Loads. Contractor shall properly cover all open debris 27 boxes during transport to the Disposal Site. 28 29 4.13 Personnel. Contractor shall furnish such qualified drivers, mechanical, 30 supervisory, clerical, management and other personnel as may be necessary to provide 31 the services required by this Agreement in a satisfactory, safe, economical and efficient 32 manner in accordance with all applicable Federal, State and local laws and regulations. 33 If additional personnel are required to meet the service standards of this Agreement, 34 Contractor shall provide such additional personnel if approved in advance by the 35 Agency. All drivers shall be trained and qualified in the operation of vehicles they 36 operate and must possess a valid license, of the appropriate class, issued by the 37 California Department of Motor Vehicles and participate in periodic driver safety 38 trainings. 39 40 Contractor also agrees to establish and vigorously enforce an educational 41 program which will train Contractor's employees in the identification of Hazardous 42 Waste. Contractor's employees shall not knowingly place such Hazardous Waste in the 43 Collection vehicles, nor knowingly dispose of such Hazardous Wastes at the Processing 44 Facility or Disposal Site.
