<br />1 per twelve (12) month period, the Contractor shall make Containers available for <br />2 purchase at a price not to exceed the cost to Contractor of purchasing the Containers. <br />3 <br />4 4.12 Litter Abatement. <br />5 <br />6 4.12.1. Minimization of Spills. Contractor shall use due care to prevent <br />7 Solid Waste, Recyclable Materials and/ or Plant Materials or fluids from leaking being <br />8 spilled and/or scattered during the Collection or transportation process. If any material <br />9 or fluids leak or are spilled during Collection, Contractor shall promptly clean up all <br />10 such materials. Each Collection vehicle shall carry a broom and shovel at all times for <br />11 this purpose. <br />12 <br />13 Contractor shall not transfer loads from one vehicle to another on any <br />14 public street, unless it is necessary to do so because of mechanical failure, accidental <br />15 damage to a vehicle, or a pre-approved method of Solid Waste transfer between <br />16 vehicles, without prior written approval by Agency. <br />17 <br />18 4.12.2 Clean Up. During the Collection or transportation process, <br />19 Contractor shall clean up litter in the immediate vicinity of any storage area (including <br />20 the areas where Collection bins and debris boxes are delivered for Collection) whether <br />21 or not Contractor has caused the litter. Contractor shall discuss instances of repeated <br />22 spillage not caused by it directly with the Waste Generator responsible and will report <br />23 such instances to Agency. Agency will attempt to rectify such situations with the Waste <br />24 Generator if Contractor has already attempted to do so without success. <br />25 <br />26 4.12.3 Covering of Loads. Contractor shall properly cover all open debris <br />27 boxes during transport to the Disposal Site. <br />28 <br />29 4.13 Personnel. Contractor shall furnish such qualified drivers, mechanical, <br />30 supervisory, clerical, management and other personnel as may be necessary to provide <br />31 the services required by this Agreement in a satisfactory, safe, economical and efficient <br />32 manner in accordance with all applicable Federal, State and local laws and regulations. <br />33 If additional personnel are required to meet the service standards of this Agreement, <br />34 Contractor shall provide such additional personnel if approved in advance by the <br />35 Agency. All drivers shall be trained and qualified in the operation of vehicles they <br />36 operate and must possess a valid license, of the appropriate class, issued by the <br />37 California Department of Motor Vehicles and participate in periodic driver safety <br />38 trainings. <br />39 <br />40 Contractor also agrees to establish and vigorously enforce an educational <br />41 program which will train Contractor's employees in the identification of Hazardous <br />42 Waste. Contractor's employees shall not knowingly place such Hazardous Waste in the <br />43 Collection vehicles, nor knowingly dispose of such Hazardous Wastes at the Processing <br />44 Facility or Disposal Site. <br /> Atty j Agrj2005.022 <br /> 060205 -24- <br />
