<br />1 Contractor or an affiliate or subsidiary of Contractor under a separate agreement with <br />2 San Mateo County. <br />3 <br />4 4.25 Service Exceptions; Hazardous Waste Notifications. <br />5 <br />6 A. Failure to Collect. When Solid Waste is not Collected from any <br />7 service recipient, Contractor shall notify its service recipient in writing, at the time <br />8 Collection is not made, through the use of a "tag" or otherwise, of the reasons why the <br />9 Collection was not made. <br />10 <br />11 B. Hazardous Waste Inspection and Reporting. Contractor reserves <br />12 the right and has the duty under law to inspect Solid Waste, Recyclable Materials, <br />13 Commercial ()rganic Materials and Plant Materials put out for Collection and to reject <br />14 Solid Waste, Recyclable Materials, Commercial ()rganic Materials and Plant Materials <br />15 observed to be contaminated with Hazardous Waste and the right not to Collect <br />16 Hazardous Waste put out with Solid Waste, Recyclable Materials, Commercial ()rganic <br />17 Materials and Plant Materials. Contractor shall notify all applicable agencies, if <br />18 appropriate, including the California Department of Toxic Substances Control and <br />19 Local Emergency Response Providers and the National Response Center of reportable <br />20 quantities of Hazardous Waste, found or observed in Solid Waste, Recyclable <br />21 Materials, Commercial ()rganic Materials and Plant Materials anywhere within Agency. <br />22 In addition to other required notifications, if Contractor observes any substances which <br />23 it or its employees reasonably believe or suspect to contain Hazardous Wastes <br />24 unlawfully Disposed of or released on any Agency property, including storm drains, <br />25 streets or other public rights of way, Contractor will immediately notify the Agency and <br />26 SBWMA. <br />27 <br />28 C. Hazardous Waste Diversion Records. Contractor shall maintain <br />29 records showing the types and quantities, if any, of Hazardous Waste found in Solid <br />30 Waste, Recyclable Materials, Commercial ()rganic Materials and Plant Materials and <br />31 which was inadvertently Collected from service recipients within the Agency, but <br />32 diverted from landfilling. <br />33 <br />34 <br />35 ARTICLE 5 <br />36 OTHER SERVICES <br />37 <br />38 5.01 Services and Service Recipient Billing. <br />39 <br />40 5.01.1 Service. Contractor shall periodically prepare and distribute a <br />41 notice to each service recipient entitled or mandated to receive service under this <br />42 Agreement listing Contractor's standard rates, rates for other services, annual holiday <br />43 schedule, and a general summary of services required under this Agreement to be <br />44 provided service recipients and optional services which may be furnished by <br /> Atty j Agrj2005.022 <br /> 060205 -27- <br />
