<br />1 Contractor. Such notice shall be in a form subject to the Agency's approval prior to its <br />2 distribution and may be included with Billings made by Agency. Contractor's costs for <br />3 services under this Section shall be deemed ()perating Costs. <br />4 <br />5 5.01.2 Billing. Agency shall prepare, mail and collect bills (or shall issue <br />6 written receipts for cash payments) for Solid Waste Services provided by Contractor. <br />7 Bills for service shall be issued periodically as Agency shall determine. Agency shall <br />8 remit to Contractor revenues received not less than -monthly. Agency shall have the <br />9 right to revise the billing format (size, font, frequency, etc.) and to itemize certain <br />10 charges. Agency may also provide mailers relating to service with the Billings. The <br />11 mailers must fit in standard envelopes and not increase the required postage. Agency <br />12 may also insert with the Billings, mailers describing activities of Agency. Contractor - <br />13 may provide Agency mailers prepared by Contractor and if so, at least thirty (30) days <br />14 prior to Agency's designated mailing date. All Contractor generated mailers must be <br />15 approved in advance by the Agency and SBWMA with the exception of Contractor's <br />16 quarterly newsletter. <br />17 <br />18 Agency shall maintain copIes of said Billings and receipts, In <br />19 chronological order, for a period of three (3) years after the date of service. Agency may, <br />20 at its option, maintain those records in computer form, on microfiche, or in any other <br />21 manner, provided that the records can be preserved and retrieved for inspection and <br />22 verification in a timely manner. <br />23 <br />24 Agency shall establish rates for the types of service provided. Agency <br />25 shall bill and collect at those rates .Service recipients will be considered delinquent sixty <br />26 (60) days after start of the quarter in which the services are provided. Contractor may <br />27 discontinue service to any account, if payment is not received by Contractor within <br />28 thirty (30) days after the end of the quarter in which the bill was issued. Contractor <br />29 must provide all accounts with written notice of its intent to discontinue service at least <br />30 thirty (30) days prior to such discontinuance. Any disputes related to billing shall be <br />31 handled as described in Section 5.02.3. <br />32 <br />33 5.01.3 Agency as Billing Agency Agency shall act as Billing agent on <br />34 behalf of Contractor. Revenues collected on behalf of the SBWMA or Agency shall be <br />35 handled as described in Article 3 of this Agreement. <br />36 <br />37 5.01.4 Review of Billings. Agency and Contractor shall review Agency's <br />38 Billings to service recipients under Section 5.01.2. The purpose of the review is to <br />39 determine that the amount which Agency is billing each service recipient is correct in <br />40 terms of the level of service (i.e., frequency of Collection, size of container, location of <br />41 container) being provided to such service recipient by Contractor. Agency and <br />42 Contractor shall review service recipient accounts not less than every other year, unless <br />43 Agency shall direct Contractor to do so annually. The intent of this Section is for <br />44 Agency and Contractor to review billings on an annual basis which will cover the entire <br /> Atty j Agrj2005.022 <br /> 060205 -28- <br />
