1 Contractor. Such notice shall be in a form subject to the Agency's approval prior to its 2 distribution and may be included with Billings made by Agency. Contractor's costs for 3 services under this Section shall be deemed ()perating Costs. 4 5 5.01.2 Billing. Agency shall prepare, mail and collect bills (or shall issue 6 written receipts for cash payments) for Solid Waste Services provided by Contractor. 7 Bills for service shall be issued periodically as Agency shall determine. Agency shall 8 remit to Contractor revenues received not less than -monthly. Agency shall have the 9 right to revise the billing format (size, font, frequency, etc.) and to itemize certain 10 charges. Agency may also provide mailers relating to service with the Billings. The 11 mailers must fit in standard envelopes and not increase the required postage. Agency 12 may also insert with the Billings, mailers describing activities of Agency. Contractor - 13 may provide Agency mailers prepared by Contractor and if so, at least thirty (30) days 14 prior to Agency's designated mailing date. All Contractor generated mailers must be 15 approved in advance by the Agency and SBWMA with the exception of Contractor's 16 quarterly newsletter. 17 18 Agency shall maintain copIes of said Billings and receipts, In 19 chronological order, for a period of three (3) years after the date of service. Agency may, 20 at its option, maintain those records in computer form, on microfiche, or in any other 21 manner, provided that the records can be preserved and retrieved for inspection and 22 verification in a timely manner. 23 24 Agency shall establish rates for the types of service provided. Agency 25 shall bill and collect at those rates .Service recipients will be considered delinquent sixty 26 (60) days after start of the quarter in which the services are provided. Contractor may 27 discontinue service to any account, if payment is not received by Contractor within 28 thirty (30) days after the end of the quarter in which the bill was issued. Contractor 29 must provide all accounts with written notice of its intent to discontinue service at least 30 thirty (30) days prior to such discontinuance. Any disputes related to billing shall be 31 handled as described in Section 5.02.3. 32 33 5.01.3 Agency as Billing Agency Agency shall act as Billing agent on 34 behalf of Contractor. Revenues collected on behalf of the SBWMA or Agency shall be 35 handled as described in Article 3 of this Agreement. 36 37 5.01.4 Review of Billings. Agency and Contractor shall review Agency's 38 Billings to service recipients under Section 5.01.2. The purpose of the review is to 39 determine that the amount which Agency is billing each service recipient is correct in 40 terms of the level of service (i.e., frequency of Collection, size of container, location of 41 container) being provided to such service recipient by Contractor. Agency and 42 Contractor shall review service recipient accounts not less than every other year, unless 43 Agency shall direct Contractor to do so annually.
