Participation and set-out rates in same format as <br /> 6 number of accounts. <br /> 7 <br /> 8 4. End Uses. Sales statement showing: quantity of <br /> 9 material by type and type of end-use. <br /> 10 <br /> 11 5. Recyclable Material sales revenue by material type. <br /> 12 <br /> 13 C. Meet and Confer with Agency and/or SBWMA. Beginning <br /> 14 on the effective date of the Agreement, and then on a quarterly basis thereafter, <br /> 15 Contractor shall meet with the Agency and! or SBWMA to describe the progress of <br /> 16 each active diversion program. Contractor should document the results of the <br /> 17 programs on a monthly basis, including at a minimum the tonnage diverted by <br /> 18 material type, the end use or processor of the diverted materials and the cost per ton <br /> 19 for transporting and processing each type of material and other such information <br /> 20 requested by the Agency and! or SBWMA necessary to evaluate the performance of <br /> 21 each program. <br /> 22 <br /> 23 At each quarterly meeting, the Agency and! or SBWMA and <br /> 24 Contractor shall have the opportunity to revise the program based on mutually agreed <br /> 25 upon terms. The Agency and! or SBWMA shall have the right to terminate a program if <br /> 26 in its sole discretion, the Contractor is not cost effectively achieving the program's goals <br /> 27 and objectives. Prior to such termination, the Agency and! or SBWMA shall meet and <br /> 28 confer with the Contractor for a period of up to 90 days to resolve the Agency and! or <br /> 29 SBWMA's concerns. Thereafter, the Agency and! or SBWMA may utilize a third party <br /> 30 to perform these services if the Agency and! or SBWMA reasonably believes the third <br /> 31 party can improve on Contractor's performance and! or cost. Notwithstanding these <br /> 32 changes, Contractor should continue the program during the meet and confer period <br /> 33 and, thereafter, until the third party takes over the program. <br /> 34 <br /> 35 D. Other Programs. For each program, provide activity related <br /> 36 and narrative reports on goals and milestones and accomplishments. Describe <br /> 37 problems encountered, actions taken and any recommendations to facilitate progress. <br /> 38 Describe vehicles, personnel, and equipment utilized for each program. <br /> 39 <br /> 40 E. Summary Assessment. Provide a summary assessment of <br /> 41 the overall Solid Waste program from Contractor's perspective relative to financial and <br /> 42 physical status of program. The physical status summary is to report: operating <br /> 43 efficiency, economy and effectiveness of the program relative to the goals and objectives <br /> 44 of this Agreement including particularly the Agency's diversion goals; provide <br /> Atty j Agrj2005.022 <br /> 060205 -45- <br />
