<br /> 1 Rate Year <br /> 2 "Rate Year" means the twelve month period, commencing January 1, of one year and <br /> 3 concluding December 31 of the same year, for which Contractor compensation is <br /> 4 calculated. <br /> 5 Recycling <br /> 6 II Recycling" means the process of collecting, sorting, cleansing, treating and <br /> 7 reconstituting discarded materials which meet the quality standards necessary to be re- <br /> 8 used, remanufactured or processed. The Collection, transportation or Disposal of Solid <br /> 9 Waste not intended for, or capable of, reuse is not Recycling. <br /> 10 Recyclable Materials <br /> 11 "Recyclable Materials" means discarded materials that are re-used, remanufactured or <br /> 12 processed. <br /> 13 Related Party Entity <br /> 14 "Related Party Entity II means any Affiliate which has financial transactions with <br /> 15 Contractor pertaining to this Agreement. <br /> 16 Residential Property <br /> 17 "Residential Property II means property used for residential purposes. <br /> 18 Service Area <br /> 19 "Service Area" means that territory within, and, if applicable, outside Agency's <br /> 20 boundaries with respect to which Agency exercises franchising authority for the <br /> 21 collection of Solid Waste, Recyclable Materials, Commercial ()rganic Materials and <br /> 22 Plant Materials which territory is shown on a map on file in the office of Agency's <br /> 23 Manager, to which reference is hereby made for the description of said area. <br /> 24 Single Family Dwellings <br /> 25 "Single Family Dwellings" means each Premises used for or designated as a single <br /> 26 family residential dwelling, including each unit of a duplex, triplex or townhouse <br /> 27 condominium in all cases in which there is separate or individual Solid Waste, <br /> 28 Recyclable Materials, and Plant Materials Collection are provided separately to each <br /> 29 dwelling unit. <br /> 30 Solid Waste <br /> 31 "Solid Waste" means all putrescible and nonputrescible solid, semisolid, and liquid <br /> 32 wastes, as defined in California Public Resources Code 940191, as that section may be <br /> 33 amended from time to time. For the purposes of this Agreement, "Solid Waste" does <br /> 34 not include abandoned vehicles and parts thereof, Hazardous Waste or low-level <br /> 35 radioactive waste, medical waste, Recyclable Materials, or Plant Materials. <br />
