<br /> 1 Owner
<br /> 2 "()wner" means the Person holding the legal title to the real property constituting the
<br /> 3 Premises to which Solid Waste, Recyclable Materials, Commercial ()rganic Materials
<br /> 4 and Plant Materials Collection service is to be provided under this Agreement.
<br /> 5 Operating Cost
<br /> 6 "Operating Cost" means those costs reasonably necessary and actually incurred by
<br /> 7 Contractor to perform under this Agreement, excluding only those costs specifically
<br /> 8 excluded in this Agreement.
<br /> 9 Pass-Through Cost
<br /> 10 "Pass- Through Cost" means a particular cost to which no element of overhead,
<br /> 11 administrative expense, profit, or other cost is added nor with respect to which any
<br /> 12 other amount is credited, such that the specific amount of such cost is included without
<br /> 13 modification in the calculations or reports to which such costs pertain.
<br /> 14 Person
<br /> 15 "Person" means any individual, firm, association, organiza tion, partnership,
<br /> 16 corporation, business trust, joint venture, the United States, the State of California, the
<br /> 17 County of San Mateo, towns, cities, or special purpose districts.
<br /> 18 Plant Materials
<br /> 19 "Plant Materials" means a subset of organic Recyclable Materials consisting of grass
<br /> 20 cuttings, weeds, leaves, prunings, branches, dead plants, brush, tree trimmings, dead
<br /> 21 trees (not more than six (6) inches in diameter) and four (4) feet in length, and similar
<br /> 22 materials generated at Premises within Agency, separated and set out for Collection,
<br /> 23 processing, and Recycling. Plant Materials does not include materials not normally
<br /> 24 produced from farms, gardens or landscapes, such as, but not limited to, brick, rock,
<br /> 25 gravel, large quantities of dirt, concrete, sod, non-organic wastes, oil, and painted or
<br /> 26 treated wood or wood products. Diseased plants and trees are also excluded from
<br /> 27 Plant Materials.
<br /> 28 Plant Materials Processing Facility
<br /> 29 "Plant Materials Processing Facility" means a permitted Facility where Plant Materials
<br /> 30 are sorted, ground and chipped, mulched or separated for the purposes of land
<br /> 31 application, alternate daily cover, reuse or composting, so long as that material is
<br /> 32 diverted from landfill disposal.
<br /> 33 Premises
<br /> 34 "I'remises" means any land, or building in Service Area where Solid Waste is generated
<br /> 35 or accumulated.
