<br /> 1 1980, 42 USC 99601 et seq.(CERCLA); (ii) the Hazardous Materials Transportation Act, <br /> 2 49 USC 91802, et seq.; (iii) the Resource Conservation and Recovery Act, 42 USC 96901 <br /> 3 et seq.; (iv) the Clean Water Act, 33 USC 91251 et seq.; (v) California Health and Safety <br /> 4 Code 9925115-25117, 25249.8,25281, and 25316; (vi) the Clean Air Act, 42 USC 97901 et <br /> 5 seq.; and (vii) California Water Code 913050; (b) any amendments, rules or regulations <br /> 6 promulgated thereunder to such enumerated statutes or acts currently existing or <br /> 7 hereafter enacted; and (c) any other hazardous or toxic substance, material, chemical, <br /> 8 waste or pollutant identified as hazardous or toxic or regulated under any other <br /> 9 applicable federal, state or local Environmental Laws currently existing or hereinafter <br /> 10 enacted, including, without limitation, friable asbestos, polychlorinated biphenyl's <br /> 11 (IPCBs"), petroleum, natural gas and synthetic fuel products, and by-products. <br /> 12 Hazardous Waste <br /> 13 "Hazardous Waste II means all substances defined as Hazardous Waste, acutely <br /> 14 Hazardous Waste, or extremely Hazardous Waste by the State of California in Health <br /> 15 and Safety Code 925110.02, 925115, and 925117 or in the future amendments to or <br /> 16 recodifications of such statutes or identified and listed as Hazardous Waste by the US <br /> 17 Environmental Protection Agency (EP A), pursuant to the Federal Resource <br /> 18 Conservation and Recovery Act (42 USC 96901 et seq.), all future amendments thereto, <br /> 19 and all rules and regulations promulgated thereunder. <br /> 20 <br /> 21 Manager <br /> 22 "Manager" means Agency's chief executive officer, howsoever designated by Agency, <br /> 23 or his or her designee. <br /> 24 Materials Recovery Facility (MRF) <br /> 25 "Materials Recovery Facility" means a permitted Facility where Solid Waste, Recyclable <br /> 26 Materials, or Plant Materials are sorted or separated for the purposes recovering <br /> 27 reusable or Recyclable Materials. <br /> 28 Multi-Family Residential Complex <br /> 29 "Multi-Family Residential Complex" means any residential Premises, other than a <br /> 30 Single Family Dwelling, used for residential purposes. Such Premises normally have <br /> 31 centralized Solid Waste and Recyclable Materials Collection service for all units in the <br /> 32 building and are billed as one address. <br /> 33 Original Agreement <br /> 34 "()riginal Agreement" means the Agreement dated September 9, 1999 and effective <br /> 35 March 1, 2000. <br />
