<br /> 1 Porter-Cologne Water Quality Control Act, California Water Code 913000 et seq.; the <br /> 2 Safe Drinking Water and Toxic Enforcement Act, California Health and Safety Code <br /> 3 925249.5 et seq.; as currently in force or as hereafter amended, and all rules and <br /> 4 regulations promulgated thereunder. <br /> 5 FacilityjFacilities <br /> 6 II Facility jFacilities" means any plant or site, owned or leased and maintained, operated <br /> 7 or used by Contractor or the SBWMA for purposes of performing Contractor's <br /> 8 obligations under this Agreement. Subject to Section 2.09 of this Agreement, <br /> 9 Contractor and Agency have designated the San Carlos Transfer Station located at 225 <br /> 10 Shoreway Road and the San Carlos "Recyclery" located 333 Shoreway Road and any <br /> 11 other building and improvement located at these addresses in the City of San Carlos <br /> 12 (including the administration and vehicle repair and maintenance building) as its <br /> 13 Facilities to be utilized under this Agreement. <br /> 14 Fiscal Year <br /> 15 "Fiscal Year" means the period commencing January 1 and concluding December 31 of <br /> 16 year for Contractor. <br /> 17 Full Regulatory Compliance <br /> 18 "Full Regulatory Compliance II means compliance with all applicable permits for a <br /> 19 Facility such that the Contractor will at all times maintain the ability to fully comply <br /> 20 with its obligations under this Agreement. <br /> 21 Franchise Fee <br /> 22 "Franchise Fee" means the fee paid by Contractor to Agency for the right to hold the <br /> 23 franchise granted by this Agreement. <br /> 24 Gross Revenues <br /> 25 "Gross Revenues" means any and all revenue or compensation in any form to <br /> 26 Contractor or other Affiliates of Contractor, for the Collection, transportation and <br /> 27 processing of Solid Waste pursuant to this Agreement, determined in accordance with <br /> 28 Generally Accepted Accounting Principles, including, but not limited to, service <br /> 29 recipient fees for Collection of Solid Waste, without subtracting the other cost of doing <br /> 30 business. <br /> 31 Hazardous Substance <br /> 32 "Hazardous Substance II shall mean any of the following: (a) any substances defined, <br /> 33 regulated or listed (directly or by reference) as "Hazardous Substances", "hazardous <br /> 34 materials ", "Hazardous Wastes ", "toxic waste ", "pollutant" or "toxic substances II or <br /> 35 similarly identified as hazardous to human health or the environment, in or pursuant <br /> 36 to (i) the Comprehensive Environmental Response, Compensation and Liability Act of <br />
