<br /> 1 Contractor <br /> 2 "Contractor" means BFI Waste Systems of North America (a wholly- owned subsidiary <br /> 3 of Browning-Ferris Industries, LLC), a limited liability company duly organized and <br /> 4 existing in good standing under the laws of the State of Delaware and its officers, <br /> 5 directors, employees, agents, companies and subcontractors. <br /> 6 Contractor Compensation <br /> 7 "Contractor Compensation" means the revenue received by the Contractor from <br /> 8 Billings for providing services in accordance with this Agreement. <br /> 9 Curbside <br /> 10 "Curbside" means the location of a Container for pick-up, not more than fifteen (15) <br /> 11 feet from the street curb. Where no street curb exists, the location shall be within five <br /> 12 (5) feet from the outside edge of the street nearest the property's entrance. <br /> 13 Demolition Debris <br /> 14 "Demolition Debris" means used or discarded construction materials generated during <br /> 15 the razing or renovation of a structure. <br /> 16 Designated Waste <br /> 17 "Designated Waste" means auto fluff, and petroleum-contaminated soils. <br /> 18 Disposal <br /> 19 "Disposal" means the ultimate disposition of Solid Waste collected by Contractor at a <br /> 20 Disposal Site in Full Regulatory Compliance. <br /> 21 Disposal Site(s) <br /> 22 "Disposal Site(s)" means the Solid Waste facility or facilities utilized for the ultimate <br /> 23 landfill Disposal of Solid Waste Collected by Contractor. The Ox Mountain Landfill <br /> 24 owned by Contractor, shall be the designated Disposal Site of Contractor as of the <br /> 25 effective date of this Agreement. <br /> 26 Environmental Laws <br /> 27 "Environmental Laws" means all federal and state statutes, county, local and Agency <br /> 28 ordinances concerning public health, safety and the environment including, by way of <br /> 29 example and not limitation, the Act, the Comprehensive Environmental Response, <br /> 30 Compensation and Liability Act of 1980, 42 USC 99601 et seq.; the Resource <br /> 31 Conservation and Recovery Act, 42 USC 96902 et seq.; the Federal Clean Water Act, 33 <br /> 32 USC 91251 et seq.; the Toxic Substances Control Act, 15 USC 91601 et seq.; the <br /> 33 ()ccupational Safety and Health Act, 29 USC 9651 et seq.; the California Hazardous <br /> 34 Waste Control Act, California Health and Safety Code 925100 et seq.; the California <br /> 35 Toxic Substances Control Act, California Health and Safety Code 925300 et seq.; the <br />
