-LB <br /> <br /> A. City shall purchase on-line access to its claims database. The one <br /> time fee for such service shall be $2,500 for the first year of service and $2,000 <br /> for each year thereafter. <br /> <br /> B. In the event of a significant change in exposure base, <br /> misrepresentation, or legislative changes, the parties hereto reserve the right to <br /> renegotiate the fee schedule. <br /> <br /> III. RENEWAL OF AGREEMENT <br /> <br /> After the first year of service under this Agreement, this Agreement and <br />amendments thereto may be renewed from year to year provided that any proposed <br />revision in this Agreement by either party be submitted in writing no later than 90 days <br />preceding the expiration of this Agreement. <br /> <br /> IV. TERMINATION OF AGREEMENT <br /> <br /> A. Either party may terminate this Agreement by submitting to the other party in <br />writing, its intent to terminate at least 60 days prior to the date of termination. <br /> <br /> B. All claim files are the property of the City and will be made available to the <br />City at its request. If the City requests claims computer data, there will be a one time <br />charge of $500 per tape or other media. Any custom downloads of data or reformatting <br />of claims data will be charged at a rate of $185 per hour. Vendor data is the property of <br />CMl. <br /> <br /> V. INCORPORATION OF PERFORMANCE STANDARD-~ <br /> <br /> CMl agrees to comply with its Scope of Services as described in CMI's proposal <br />provided to City on December 6, 2001, which is on file with the City Clerk's office.
