(c) Requires all regional wholesale water suppliers, including San Francisco, to make <br />their facilities available to convey supplemental water during shortage conditions. <br /> <br />Section 73505 directs DOHS to require regional wholesale water suppliers, including San <br />Francisco, to deliver water that meets State drinking water standards to all wholesale customers <br />except those with their own filtration plants or whose contracts state that the water does not need <br />to meet drinking water standards. <br /> <br />Section 73506 requires California Department of Water Resources ("DWR") to audit San <br />Francisco's program of preventative maintenance on the regional system every two years until <br />2010 and submit report biennially to Legislature with recommendations. Requires similar audits <br />of other regional wholesale water suppliers by 2006. <br /> <br />Section 73507 provides that, if the Master Contract is not renewed or extended when it expires <br />in 2009, the California Public Utilities Commission ("CPUC") will have jurisdiction over San <br />Francisco wholesale water rates. Also extends CPUC jurisdiction to rates charged by other <br />regional wholesale water suppliers as of 2009, if they do not have contracts that regulate pricing <br />in place with their wholesale customers. <br /> <br />Section 73508 relieves San Francisco from obligations of Act if and when the ownership of the <br />regional water system is conveyed to a new regional entity composed of wholesale customers <br />and San Francisco. <br /> <br />Section 73510 allows BAWUA members, and other wholesale customers, to enforce Act. Also <br />directs DWR to assume control of the San Francisco regional system if necessary to assure the <br />Act is carried out. Conditions San Francisco's eligibility for state grants on its participation in a <br />regional water entity. <br /> <br />Section 73512 requires regional wholesale water suppliers, including San Francisco, to <br />reimburse State of California for costs incurred by state agencies in implementing the Act. <br />Allows San Francisco to pass those costs through to BAWUA members as provided in the <br />Master Contract. Allows other regional wholesale water suppliers to pass through a <br />proportionate share of the costs to their wholesale customers. <br /> <br />SECTION 3 provides that sections of the Act are severable. <br /> <br />SECTION 4 provides that no reimbursement by the State of San Francisco or other local <br />agencies is required. <br /> <br />WHAT BILL DOES NOT DO: <br /> <br />Does not allow wholesale customers to "take over" the SFPUC or the Hetch Hetchy water supply <br />system. <br /> <br /> 922908.1 <br /> <br /> <br />
