AB 680: THE JANUARY 24, 2002 AMENDMENT8 <br /> <br /> The new amendments to the bill offered by Assembly Member Thomson are as follows: <br />Regi¢~nal Open Space ~d R~.creat.~o': <br /> <br /> 1. The L. eglslature shall create the Sacramento Regional Open Space and Recreation <br />Conservancy and the funding sources for the Conservancy may include: <br /> <br /> · Proposition 40 and futura State Resource Bonds <br /> · A regional impact fee <br /> <br /> 2. The Legislature shall direct the region to develop a regional impact fee on commercial <br />and residential development, excluding infill and affordable housing, taking into consideration the <br />following: <br /> <br /> · The proximity of the proposed development to the urban area. <br /> · The type of farmland, such as pdme farmland, farmland of statewlde importance, <br /> unique farmland, or local farmland, according to the definitions provided by the <br /> Department of Conservation's Farmland Conservancy Program. <br /> · The current levels of existing fees. Any commercial and residential development <br /> projects subject to existing fees imposed by a local government entity which have the <br /> same fundamental purpose as the regional impact fee would receive credits of up to <br /> two-thirds of the regional impact fee. The developer will always pay at least one-third <br /> of the regional impact fee. <br /> · The complexity of existing fee structure. <br /> <br /> 3. A county can opt to exempt itself and its cities from the sales tax revenue sharing <br /> requirements of this bill if the county meets the following five criteria: <br /> <br /> · Has enacted a revenue sharing agreement with two or more of its cities. <br /> · Has enacted an open space and agricultural land preservation policy, which would <br /> preserve one acre of open space or agricultural land for every one acre of land <br /> developed. <br /> · Has established a policy to limit development to within existing city boundaries, and <br /> has substantially adhered to that policy. <br /> · Provides a fair share of the region's affordable housing, <br /> · The homeless shelter provisions in the bill with the addition of domestic violence <br /> shelters. <br /> <br /> If local government entities in the region develop an alternative revenue-sharing agreement <br /> to the agreement outlined in the bill, the agreement shall supemede the sales tax sharing portion <br /> of this bill. The bill shall be effective in 2004 to provide local government entities an opportunity to <br /> develop an alternative. <br /> <br /> THE NEW AB 680 SALES TAX DISTRIBUTION FORMULA <br /> <br /> As a reminder, the author had circulated a new version of the bill that did the following: <br /> <br /> Each city and county would retain their 2002 base year sales tax dollar amount and !:lrowth in <br /> sales tax revenues would be distributed according to the following formula: <br /> <br /> Page 2 of 6 <br /> <br /> <br />
