<br />this Agreement is in effect in accordance with the tenns of this Agreement so <br />as not to impair the efficiency or operation of Redwood City's or the <br /> <br />Authority's Sewerage Facility. <br /> <br />If repairs, construction, or other private work is necessary to be perfonned <br />within the Service Area in order to coITect, eliminate, or abate a condition <br /> <br />within said Service Area which threatens to cause, causes, or caused damage <br />to Redwood City's or the Authority's Sewage Facilities, or which otherwise <br /> <br />threatens to cause, causes, or caused a violation of any provision of the <br />Unifonn Sanitary Sewerage Ordinances of Redwood City or the Authority's <br /> <br />regulation, Redwood City or the Authority shall give written notice to Circle <br />Star and Homestead thereof, and Circle Star and Homestead shall commence <br /> <br />such repairs, construction, or work of improvements within a reasonable time <br />of such notice and diligently pursue such work to completion. <br /> <br />9. To the extent pennissib1e by law, Circle Star and Homestead agree to defend, <br />indemnify, and hold hann1ess Redwood City, its Council, boards, <br />commissions, officers, employees, and agents from any liability for damages <br /> <br />(including attorney's fees) or claims for damages resulting, or alleged to have <br />resulted, from personal injury, including death and/or liability for damages <br /> <br />(including attorney's fees) or claims for damages to property or loss thereof, <br />including loss of use or value thereof, or for environmental damages, resulting <br /> <br />in any manner, directly or indirectly, by reason of any negligent or willful act <br />or omission on the part of Circle Star and Homestead in the perfonnance of <br /> <br />its duties and obligations hereunder. <br /> <br />10. This agreement is for the benefit of the land described as Parcell in the <br />Approval of Lot Line Adjustment recorded June 25, 1997, as Document <br /> <br />Number 97-076673, San Mateo County Records, and for the benefit of the <br />land described as Parcel II in the Approval of Lot Line Adjustment recorded <br /> <br />June 25,1997, as Document Number 97-076672, San Mateo County Records. <br /> <br />- -- ----.---. -----.----.-------------------- <br />
