<br />B. <br /> <br />6. <br /> <br />A. <br /> <br />Agreement-l <br />4/27/98 <br /> <br />In the event of the breach of any provision of this section, or in the <br />event any notice is received which indicates any required insurance <br />coverage will be diminished or canceled, and not replaced by <br />Contractor, the City, at its option, may, notwithstanding any other <br />provision of this Agreement to the contrary, immediately declare a <br />material breach of this Agreement and suspend all further work <br />pursuant to this Agreement. <br /> <br />NON-DISCRIMINATION <br /> <br />Contractor shall comply with the non-discrimination requirements <br />described below: <br /> <br />Section 504 of the Rehabilitation Act of 1973 <br /> <br />(1 ) <br /> <br />Pursuant to Section 514 (Public Law 93-112), the Contractor <br />agrees that no otherwise qualified persons with disabilities <br />shall, solely by reason of a disability, be excluded from the <br />participation in, be denied benefits of, or be subjected to <br />discrimination in the performance of this contract or in the <br />selection of persons with developmental disabilities to <br />occupy the dwelling purchased under this agreement. <br /> <br />(2) <br /> <br />Compliance of Section 504 of the Rehabilitation Act of 1973, <br />as amended, requires that all benefits, aids and services are <br />made available to persons with disabilities on an equivalent <br />basis with those received by non-disabled persons. <br />Contractor shall agree to be in compliance with Section 504 <br />requirements by developing a plan for compliance to be <br />submitted to the Section 504 Coordinator as soon as <br />possible but not later than by the close of escrow for this <br />acquisition. <br /> <br />B. <br /> <br />Affirmative Action. <br /> <br />Contractor certifies that it is in compliance with the Equal <br />Employment Opportunity Requirements of Executive Order No <br />11246, as amended by Executive Order No 1375, Title VII of the <br />Civil Rights Act of 1964, the California Fair Employment Practices <br />Act and any other federal or state laws pertaining to equal <br />employment opportunity, and that it will not discriminate against <br />any employee or applicant for employment or opportunity to <br />purchase the dwelling to be built on the "property." on the basis of <br />race, religion, color, national origin, ancestry, sex, age, physical or <br />mental disability, marital status, sexual preference, or political <br /> <br />5 <br />
