�i9-/ <br /> REPOR <br /> T <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> September 26, 2005 <br /> Subject <br /> Resolution to Vacate a Portion of St. Francis Street <br /> Recommendation <br /> Adopt a Resolution to vacate a portion of St. Francis Street, south of Redwood Avenue. <br /> Background <br /> The property owner at 1535 Redwood Avenue has requested the vacation of the dead- <br /> end portion of St. Francis Street fronting his property on the north side of St. Francis <br /> Street. Attachment "A" depicts the area to be vacated. <br /> The property owner at 1605 Redwood Avenue (on the opposite side of the street) has <br /> expressed his consent for said vacation fronting his property on the south side of St. <br /> Francis Street. Per the Streets & Highways Code, a public hearing needs to be <br /> conducted to take input from any person who may have interest in this vacation. <br /> The portion of St. Francis Street adjacent to this property dead ends at Redwood <br /> Creek. Therefore, there is no pedestrian or vehicular access to the remainder of St. <br /> Francis Street further to the southeast. (The attached vicinity map shows the circulation <br /> pattern of the streets in that vicinity.) Thus, there is no practical use for this street due <br /> to the creek crossing. Also, it should be noted that this site cannot be reserved as a <br /> park, because it was originally dedicated for public use as a street. In that event, the <br /> law requires that, if that parcel is no longer used for public street purposes, the <br /> ownership reverts back to the adjoining properties. <br /> Pacific Gas and Electric, RCN, Comcast, and SBC have consented to the vacation with <br /> the condition that the vacated area be retained as a public service easement. The City <br /> also needs the easement for future watermain extension across the vacated area, and <br /> for maintenance of the Redwood Creek lined drainage channel. <br /> Staff has reviewed the vacation and recommends approvals subject to the Conditions <br /> listed on Attachment "B". The City does not need this portion of St. Francis Street for <br /> traffic circulation. The Planning Commission acted on this matter, and found the <br /> vacation to be in conformance with the General Plan. <br /> i <br /> _ _ <br />
