A ,z
Next Steps
Following the public hearing, the City Council may either vote to adopt a resolution to
vacate, or not approve the vacation at all. In the former case, the ownership of the
actual street would be determined by a records search of the chain of title. The Title
Company would then issue the appropriate title guarantee to the future owners.
As is commonly the case with public streets, the City does not own the underlying
property of dedicated streets. The City merely has a street easement (a right-of-way for
street purposes and utilities). The ownership is usually split 50/50 between the
Property Owners on each side of the street, unless chain of title shows some other
intent. This would preclude the City using the vacated parcel as a park, for example.
Alternative
The alternative is to not vacate the street, in which case it remains a dead end, un-
maintained plot of land for which the City remains liable.
Fiscal Impacts
There are no fiscal impacts to the City as a result of this street vacation.
Jon K.
