by Freedman Tung and Bottomley and the City of Redwood City Engineering <br /> Department, which documents are identified in Attachment and incorporated <br /> herein by this reference; and <br /> ii. Provide construction project management and construction <br /> administration for the activities described above. <br /> The activities described in this paragraph 1 A shall be referred to collectively as <br /> the "Services," and are more fully described in Exhibit A, which Exhibit is attached <br /> hereto and incorporated herein by this reference. <br /> B. Developer shall contract for construction of the Streetscape Improvements <br /> and Street Modifications with one or more contractors satisfactory to City and Agency, <br /> each of whom shall hold a valid contractors license in the State of California issued by <br /> the Contractors State License Board and be experienced in the work to be performed. <br /> These firms shall be referred to collectively in this Agreement as "Contractors." To the <br /> extent required by law, Developer shall pay, and shall require the Contractors to pay, <br /> prevailing wages and comply with all related labor and employment requirements as <br /> applicable to the Streetscape Improvements and Street Modifications pursuant to Labor <br /> Code Section 1770 et seq. <br /> C. Developer shall perform all of its obligations hereunder and shall conduct <br /> all operations with respect to the performance of the Services in a good, workmanlike <br /> and professional manner, with the standards of diligence and care normally employed <br /> by duly qualified persons utilizing their best efforts in the performance of comparable <br /> services in the San Francisco Bay Area who shall adhere to the standards generally <br /> prevailing for the performance of expert construction and construction project <br /> management services in the San Francisco Bay Area. Developer shall require its <br /> Contractors and Consultants to perform to these same standards. <br /> D. All Contractors and Consultants shall comply with the City's Business <br /> License Ordinance. <br /> E. Developer shall perform its Services hereunder in full compliance with <br /> applicable federal, state and local laws and regulations in effect at the time such <br /> services are rendered ("Applicable Laws"), and shall require that its Contractors and <br /> 4 <br /> 840847v8 33786/0001 <br />
