purpose of the program shall be to assist in guarding against defects and deficiency in <br /> the work of the Contractor. Developer is not authorized as a part of this service to <br /> change, revoke, alter, enlarge, relax or release any requirements of the Contract <br /> Documents or to approve or accept any work not performed in accordance with the <br /> Contract Documents. Communication between the Developer and Contractor with <br /> regard to Quality Review shall not in any way be construed as binding the City and <br /> Agency as releasing the Developer or Contractor from the fulfillment of any of the terms <br /> of his Contract Documents. <br /> D. Completion of the Project <br /> i) Developer shall advise the City and Agency when he believes the <br /> Streetscape Improvements and Street Modifications are substantially complete. Before <br /> City and Agency issue a Certificate of Substantial Completion, Developer, City and <br /> Agency shall prepare a list of incomplete work which does not conform to the Contract <br /> Documents. This list shall be attached to the Certificate of Substantial Completion. <br /> ii) Developer shall advise the City and Agency when he believes the <br /> Streetscape Improvements and Street Modifications are finally completed, and shall <br /> provide to the City and Agency a written recommendation regarding acceptance of the <br /> Streetscape Improvements and Street Modifications. City and Agency will issue a <br /> Certificate of Completion when they determine that the Streetscape Improvements and <br /> Street Modifications are complete. <br /> iii) Developer shall make recommendations to the City and Agency <br /> concerning filing of any notices of completion required or permitted to be filed upon the <br /> completion of the Project and taking such actions as may be required to obtain any <br /> certificates of occupancy or equivalent documents required to permit the occupancy of <br /> any improvements. City and Agency shall record a Notice of Completion after the City <br /> Council and Agency Board accept the Streetscape Improvements and Street <br /> Modifications, and shall provide Developer with a duplicate copy of the Notice of <br /> Completion showing thereon the date of filing with said County Recorder. <br /> iv) Developer shall receive from the Contractor operation and maintenance <br /> manuals, warranties and guarantees for materials and equipment installed in the <br /> Streetscape Improvements and Street Modifications, bind such documents in an <br /> organized manner and deliver the materials to the City and Agency promptly upon <br /> completion of the Streetscape Improvements and Street Modifications. <br /> v) Developer shall coordinate and expedite submittals of information from the <br /> Contractors for record drawings and specification preparation and shall coordinate and <br /> expedite the transmittal of record documents to the City and Agency. The record <br /> documents shall include a complete, accurate set of drawings for the Streetscape <br /> Improvements and Street Modifications, the relocated utilities, and any other portions of <br /> the Project for which City and Agency may have maintenance or operations <br /> responsibility showing the actual location of all facilities and improvements as installed. <br /> 5 <br /> 840847v8 33786/0001 <br />
