Code §§ 21000 et seq.), and reviewed and considered by the City ColU1cil of <br />City prior to approving the Project, the Existing Approvals and this Agreement . <br /> <br />Project Open Space. That portion of the Project site to be used primarily to open <br />space and recreational uses, along with complementary facilities, including the Waterfront <br />Park, the Playfields, the Berm, pedestrian, cycling and other trails and paths and specialized, <br />complementary accessory uses and structures within the Project Open Space, all of which is <br />Intended for the benefit of the occupants of the Project and some of which is specifically <br />intended to benefit the general public, and all of which is intended to remain in private <br />ownership. The Project Open Space consists of portions of the Common Parcels and the <br />Accessory Building Parcels. <br /> <br />Project Site 'or Site. The Property. <br /> <br />Property. The real property more particularly described in Exhibit A on which <br />Pacific Shores intends to develop the Project. <br /> <br />Public Facilities. The Seaport Boulevard Improvements and the Water and Sewer <br />Facilities and the Storm Drainage Joint Facilities- <br /> <br />Seaport Boulevard Improvements. All those improvements to and adjacent to the <br />roadway gcncrolly known (l5 Seaport Boulevard from Seaport Court to the Project Site <br />planned and designed to provide access and utilities to the Project Site via a 4-lane <br />landscaped roadway adjacent to, east of and separated by a landscaped median from the <br />existing 2-lane roadway (the latter being referred to herein and in the Exchange Agreement as <br />the Frontage Road), including resurfacing of the Frontage Road, all in accordance with <br />Existing Approvals and the Exchange Agreement, and including new and/or relocated utilities <br />and facilities connecting from the Other City Facilities to the Pacific Shores Infrastructure or <br />otherwise required for development of the Project Site, including without limitation, <br />acquisition of land or interests therein as necessary. curbs, gutters, roads, water lines, sanitary <br />sewer lines, force mains and pump or lift stations, SlOnn drainage catch basins, lines, force <br />mains, retention basins, culverts and ditches, and pump stations, traffic signs. traffic signals <br />and lane striping, sidewalks, bicycle paths and landscaped borders and medians, irrigation <br />lines, street lighting, gas, electricity, cable television and fiber optic lines, spare conduits for <br />future use and relocated utilities, including relocation of high-voltage power lines; all to be <br />located within a City right-of-way (held by easement or owned in fee) and to afford service to <br />the Project Site and, as the City shall determine, to other properties served by the right-of- <br />way. The Seaport Boulevard Improvements are illustratively depicted on Exhibit B-6. <br /> <br />Storm Drainage Joint Facilities. The stonnwater pump station on the Project Site to <br />serve jointly the Seaport Boulevard Improvements and the Project Site and that stann <br />drainage line, appurtenances and outfall to be installed for discharge of stormwater to <br />Redwood Creek from such pump station to and within that access and utilities easement <br />across the parcel owned by RMC Lonestar held by Pacific Shores and recorded at Page Reel <br />7791 Image 1188, at Paragraph 2, with Legal Description at Page Reel 7791 Image 1199, to <br /> <br />.
