<br />establish construction standards that are intended to be applied ministerially to the
<br />construction of buildings on private property. The Building Regulations do not include that
<br />portion of any ordinance, resolution, code, rule, regulation or official policy that imposes a
<br />monetary Exaction.
<br />
<br />Building Zone Area. That portion of a parcel within which buildings may be located
<br />subject to any restriction on floor area or building dimensions provided herein, as shown on
<br />Exhibit 8-1.
<br />
<br />Common Parcels. Those parcels designated as lettered lots A through I on
<br />Exhibit 8-1, as they may be modified from time to time, including most of the Project Open
<br />Space and the Private Loop Road, to be owned by Pacific Shores or its designated successor
<br />and maintained for the benefit of the owners of all Building Parcels as set forth in the CCRs
<br />for the Project.
<br />
<br />Development Agreement Law. Sections 65864 through 65869.5 of the Caliiomia
<br />Government Code.
<br />
<br />J.laster Development Plan. The plan for development of the Property for the Project
<br />shown in Exhibit B.
<br />
<br />Development Regulations. The ordinances, resolutions, codes, rules, regulations
<br />and official policies of City governing zoning, land use, permitted uses, building density,
<br />building height, building size, building design, land division and engineering standards, that
<br />are applicable to the development of real property within City. Specifically, but without
<br />limiting the generality of the foregoing, the Development Regulations include City's General
<br />Plan, City's Zoning Ordinance, and City's Subdivision Code. The Development Regulations
<br />do not include the Building Regulations.
<br />
<br />District. That assessment or financing district established by City pursuant to the
<br />Community Facilities District Law (Mello-Roos), the Improvement Act of 1913, the
<br />Improvement Act of 1911 or other similar law to own and finance all or part of the Public
<br />Facilities through the issuance of bonds and the imposition of assessments, fees or taxes on
<br />benefitting land, including the Property.
<br />
<br />Effective Date. The date on which the ordinance approving this Agreement becomes
<br />effective.
<br />
<br />EIR. The Final Environmental Impact Report for Pacific Shores Center certified
<br />May 8, 1995.
<br />
<br />E.J..U/:;tiufl. Any cost, fcc, charge, payment, assessment, or other monetary or non-
<br />monetary requirement charged or imposed by City or by City through District in connection
<br />with the development of, or construction on, or use of real property under any Development
<br />Regulation or any other law, resolution, code, rule, regulation or official policy of City other
