There <br />appeared to be some confusion in the wording on the application with respect to <br />alcoholic beverages. Ex-Commissioner Shcenckasked what the recourse would be <br />in the use of alcoholic beverages, other than permitted by the application, <br />and were found to be served at the event. Mr. Weeks stated that the parties responsible <br />for the event would be requested to discontinue the use of the hard liquor and if <br />it were not discontinued or the request ignored, the Police Department would be <br />notified and the event closed down. The Department tries to reason with applicants <br />regarding alcoholic beverages. It is when the Department finds this avenue <br />impossible that the enforcing agency is called in. <br /> <br />Mr. Weeks then pointed out that in the rules and ~egulations it specifically <br />states that"... beer, wine, and champaign are the ONLY alcoholic beverages allowed'." <br />There has been no misinterpretation of this paragraph in the past experience of the <br />Department. It was further pointed out that the rational for disallowing hard <br />liquor was the increased risk of abusive use of the buildings, lack of proper <br />portable bar facilities, and the possible intermix of youths and adults in the same <br />facility. ' <br /> <br />It was the consensus of the Connnission not to change the rules.."a.tid regulations at <br />this time but to have the Operational Policy Committee review them for further discussion. <br /> <br />AGENDA ITEM I - Discussion of PaJk Rules and Regulations <br /> <br />Mr. Weeks mentioned that Tom Ferrando sent to the Connnission in advance of the meeting <br />of a copy of the drafted ordinance for incorporating the rules and regulations into <br />ordinance form. This effort has been underway for several months. There were several <br />months. There were several items that were eliminated due to preemption, either by state ( <br />or federal law. The ordinance is now ready for the Commission review. <br /> <br />Mr. Weeks mentioned that one of the main reasons for the ordinance is that there <br />are no legal provisions to enforce many of the use rules and regulations that have <br />been in affect for some time. There appears to be a trend during the'se times where <br />everyone is questioning authority and the right to enforce rules and regulations. <br />It is felt that legal and legislative backing is imperative for enforcement of park use <br />rules and regulations. The Police Department has also found themselves in awkward positioI <br />in trying to enforce the rules without their being in ordinance form. Mr. Weeks stated <br />they had worked with the Police Department regarding the proposed ordinance. <br /> <br />Mr. Ferrando mentioned that there were still some very minor questions pending with <br />the At~orney's Office dealing with some provisions that were removed only because they <br />are included elsewhere in the Code. These matters will be cross-referenced. <br /> <br />At the con~lusion of the discussion, the following motion was made: <br /> <br />MOTION: ' <br /> <br />Commissioner Weintraub moved that the draft of the park use rules and <br />regulations ordinance be accepted and, after final clarification by <br />the City Attorney, be forwarded to the City Council for approval, <br />seconded by Commissioner Pound. The motion carried unanimously by <br />voice vote. <br /> <br />AGENDA ITEM 2 - Discu~sio~ of Agenda forJ Council-Commission Joint Meetin&- <br /> <br />Chairman Knecht mentioned that the meeting is scheduled for Monday, November 17, at <br />4:00 PM in the Community Activities Building. The Connnission indicated their main <br />concern would be to discuss development standard,s.
